Poor Service as an Owner

Please make sure this gets to management in charge of Westgate Resorts. The Pettiford family stayed from 12/24/2021 - 12/31/2021.

As owners, we were very disturbed by the poor service during our stay. First, we did not have hot water in 5217A until the last night. Three technicians came out and none were able to resolve the issue. We got lucky the last night.

Second, we called several times for trash to be picked up and no one came to pick up the trash.

I have pictures of the trash that remained uncollected for the week. We were told by our agent that we are to get a $100 credit. We were unable to meet Alyssa as we were trying to enjoy our vacation and not receive any other sales efforts (we were called several times). We expect the $100 credit to be mailed to us expeditiously.

Lastly, it took a few technicians to get our temperature right in the unit. It remained on 76 degrees most of the time. Considering we pay monthly as owners yet received this poor service, as compensation, Westgate should pay our 2022 Maintenance fees. We look to take further action if our request is not granted.

My first mistake was ever buying a timeshare. So many lies!! 14 yrs later nothing has changed! They continue to lie. I just paid them off with a $400 overage and have been jumping through hoops trying to get my money back. Lies lies and more lies. That was 2 months ago and now they want proof the check cleared although they know it did because it shows my account paid in full. Stalling to keep my money! They'll rip you off every chance they get!

My son lost his job right after we decided to buy from Westgate. We received no info, such as phone numbers in case you change your mind, or even an account number. When I finally figured out how to get hold of someone about it, they told me it's to late to get a refund because of "state laws." I feel like this is bull. I think they just don't care about people and want their money, regardless of circumstances. I'll find every place that I can to write a bad review of this company. They are awful. DO NOT BUY!!!

Westgate COULD refund your money and cancel the contract. However, your legal rights come down to the rescission period, which is defined by state laws.

The rescission period can be anywhere from 3 to 10 days. Those terms are in the contract you signed.

Most people don't read the contract, so they are not aware of those terms. To "give it back" you have to pay it off.

We purchased a timeshare with Westgate in Gatlinburg, TN 3/2010. In 11/2020, after frustrations w/ WG and personal reasons, we tried to Deed Back 2 timeshares.

Both mortgages were paid off and maintenance fees were never late. We were denied. In our communication with WG, it was mentioned that the banking information was in our Public Offering Statement. We then discovered we didn't receive the POS in paper form, even though we signed the Receipt for Timeshare Documents requesting the paper form.

The CD-ROMs only had the POS for WG of Park City, UT (not Gatlinburg)and the amendments were from 2006. I have filed with the BBB, but WG continues to claim our concerns are time-barred. I believe that in stating it is time-barre WG may be admitting to wrongdoing but claiming we just didnt find it soon enough. However, a clear case of fraud, deception, or concealment, for instance, where the plaintiff is misled into believing that the wrongful act did not occur cancels out any claim to "time-barred".

Also, the statute of limitations does not begin to run until the plaintiff reasonably should have discovered that he or she has a claim. This equitable doctrine is called the "discovery rule". We did not discover that we didn't have the correct documents until 11/2020.

There are many lawsuits involving hundreds of owners, regarding Wg and; deceit
(Hambacker, Moore, Overton, Sparks). These Lawsuits mention deception that occurred in a "standard practice" way.

We have noises people above us. Kid jumping around from 5am to 20pm. We complained they were supply to take care of it. Never did any about it. At Smokey mountains resort. But yet they will harass us

They never did anything about it.It went on all week we own timeshare in Florida for 15 years and never had any problems yes they want us to exchange our timeshare for here it will never happen told him we were interested and they harassed i us, we were told at the meeting that they would go up and check with them so we said even put us in a different unit never heard nothing else from them this was frustrating and a waste of our vacation time I would never come here again this is the worst place Ive been for Westgate I think they should refund my whole week very disappointing. We are leaving early. Cant sleep with the noise going on

Our units have been changed

We have an extended family that shares a 2 bed villa, and two one bed lockouts. We have been able to split these as they are separate units and any combo of these would work ie. using 2 bed villa and one beds on different weeks. What it appears now in our account is that we can only get a 2 bed villa if we use all 3 units at once. Splitting them, the villa and the lockouts (which we have done several years) now results in having 4 one bed lockouts. These are dark hole in the wall first floor, motel kitchen, no balcony units. The 2 bed villa if used on its own (not the 3 units together) is now 2 one bed connected units, first floor dark and no kitchen. We arrived with 6 people and were supposed to be using the 2 bed villa and a one bed lockout. We were put in 2 connecting 1 bed units (instead of the villa) and a 3rd one bed. We spent hours at the desk demanding a villa and was finally moved to one on Monday (check in Sat). Now when we look at our account it says we have a choice of using all 3 units at once OR we will get "deluxe" 2 or 3 one bed crap units with motel kitchens. In the past. we have spent one week in one bedroom, then one week in villa with family and then they spend one week in a one bed. (3 weeks total). With the number of people that come, we need the villa to be able to make meals and sleep everyone. We need a lawyer and will be looking at our purchase agreement. they are saving the 2 bed villas to give to the people who are coming for the sales pitch. We purchased a villa not a series of one bedroom crap units. I wish the Florida attorney general would go after Westgate as a fraudulent company that is selling property that is not available and already deeded. If I sold the attorney general's house to someone I would be in prison. If I rented someone a lake home with a full kitchen and a deck and then put them in a motel room when they arrived I would be in court. Why isn't Westgate being prosecuted for overselling their units? All the attorney general would have to do is look at how many deeds for each type of units there are and how many of those specific units are in the buildings multiplied by 52 weeks. Westgate would then have to report how many units they are saving for their sales pitch people also. My guess is there is thousands more deeded units than are physically available. This is fraud, other CEO's have ended up in federal prison for stuff like this. We were on the phone to our sister who is apparently gifting her part (villa) to another family member for 2022 and she was horrified to hear that the family members could arrive here and end up in nothing more than a motel room.

False-Misleading Sales

We signed up for a tour of the Orlando facility (at the Old Town kiosk) and was told we would get 7 tickets to Universal Studios for $550. To get this price we just had to sit through a 90-minute presentation/tour of Westgate Resort facility in Orlando.

Chris even wrote out what we would get and we repeated multiple times that we wanted to go to Universal. The next day we sat through the 90+ minute presentation only to go down to get our tickets and learned that Chris didn't put Universal on our receipt but put Seaworld and Aquatica. Needless to say the $550 price for Universal tickets was a joke, and we ended up paying full price plus sitting through a timeshare presentation for 90-minutes. We lived up to our end by sitting through the presentation, but we were cheated out of what was verbally promised to us.

Bad stay

I and my family came to the vacation villas resort and when we arrived there August 27th for a week the unit was dirty and hair all over the bathroom floor and the kitchen was dirty and we couldnt sleep at night because of the people above us and I called the office and nothing happened so I left early cause it was a bad experience,my name is Jerry Johnson email jerrylj777@***.com.

Charged more at check in than what email stated. No coffee makers in our room #425 waited at least 25 min each day to purchase coffee at Fortuna. No ice machines working on floors. Frozen custard machines down entire stay. No service whatsoever of receiving complimentary drinks while playing same slot machine in casino for over 2 hrs. Had to purchase own drinks since we couldnt find any waiters/waitresses to assist us! Having to wait 30+ min for an elevator cause other tower elevators were Not working! So much wasted waiting time during our short enough stay at the Westgate. Do Not recommend!

any one interested in nice timeshare, westgate towers 3 bedrooms, sleeps 8, every other year, even years,$3000 or best offer. getting older dont know how much longr to travel maintance fee $1,000 every other year, unit is lockoff, so you can split and use evey year making maintance fee $500.00, can exchage on rci or interval internation, thats what we did for 34 yrs no complaints.

most companies offering soutioins want at least $5000 plus you paying thee lawyer they asaign to you, this could go up to thousands of money.

I would recommend going to www.tug2.com and telling your story. It's free and so is the advice.

If your timeshare is in Florida you can stop paying for the timeshare and they can only hit your credit.

Florida is a non-recourse state, so they can only take back the mortgage. They cannot sue you for the difference.

Refusal to help with court order, false accounts,

We have spent a lot of money with this company, Westgate. The reps told me that to remove my ex-wife from my account I would have to purchase a new account.

They told me I would have to combine both accounts into one and purchase a new account at an amount of nearly 30,000 dollars. I have found out since then I could have removed my ex-wife from the account by simply removing her by contract since I was awarded the timeshare in the divorce. I was told by the company that my timeshare would be double that amount in value when that is also not true you can sell these timeshares for a dollar on eBay. I went to Florida in person to again talk to Westgate, this is when they told me they could not assist me in removing her even after I was making all of my payments they had no care to help me other than putting me into a whole new account to remove her.

I had no choice but to get a new account this is when things got really screwed up they were supposed to merge my account into one I was told just to get this new account and they would take care of cancelling out the other account. This was not done correctly either so now I had two accounts that I could not afford and not any closer to removing my ex-wife from the first account. Westgate was supposed to make this into one account but all they cared about was making more money and no concern that I was struggling on making both payments on those accounts. This business does not treat there customers with respect the way they should if they would have done this right in the first place I would not have had to take care of three accounts.

The only time this was fixed was when I came to Florida again for a third time, this time they sold of both of the other accounts and removed my ex from the account. This left me with a huge payment because I once again had to purchase this new account to straighten this all out and I had no interest in starting all over but I could not afford two accounts along with making the yearly property taxes on both. I should have never had to get 3 accounts just to make this go away and keep spending more money that I did not have. This started out at nearly 8000 dollars and now it is over 30000 dollars total I have put into these accounts.

This is something I have had a lot of stress over for my family and a company like this should not be doing this to customers.

Westgate has done nothing but lie to me about the steps on this. I should not be paying for Westgate employees sales people mistakes.

I have sent letters in to State Senator's to request assistance with this company. I have continued to request my money back and a release from Westgate with no response from the company.
