Corrupt, Unprofessional, Discriminatory, Unlicensed....
I apologize for the extensive, detail-oriented nature of this complaint but I want to make it clear that I have exhausted all avenues for justice, including: 1. Filing a claim with the Kansas State Attorney General 2. Notifiying the Kansas Cosmetology Board of expired & rejected license 3. Filing formal complaints with the Better Business Bureau 4. Attempting contact via e-mail, phone & voicemail to see if this business would make a good faith effort to resolve this problem 5. Requesting a permit to wage a one-person peaceful protest with Overland Park, KS police, Lenexa, KS police, Shawnee Mission, KS police & Kansas-based ACLU (American Civil Liberties Union) 6. Filing a small claims dispute ____________________________________________________ Below you will find detailed notes that I have kept during this personal nightmare.... _____________________________________________________ 1. After a consult on 11/9/18 & putting down a deposit to order new hair extensions for an estimated price of $189.00 2. On 11/12/18, I returned to the studio to have my old extensions removed & the newly purchased ones put in. 3. The studio purchased two packages of hair, even though I only needed one package of hair. 4. They put the hair in and within 12 hours, the new hair was falling out. 5. I contacted Voga via email & phone to let them know what happened. I left a voicemail (after hours). 6. In my voicemail & email, I offered to return to the salon on the following day (11/13/18) to do one of the following things: a. Have the Remy hair removed (the brand Voga uses) & refund my money (including the hair they purchased with my credit card that I didn't receive) b. Have a LICENSED cosmetologist in their salon, remove the Remy hair, put in NEW extensions from a different legitimate hair provider at NO EXPENSE to me. c. Refund my money, let me keep the hair & recommend a viable salon that could do the job professionally. 7. On 11/13/18, I received a phone call from the Overland Park police saying that they had been contacted by Voga Salon & told me to not return to the business premises. When I asked how the situation escalated to the point where my desire to receive the services & product I paid for led to contacting law enforcement. The officer claimed that the salon received a voicemail at 1:30 am and that was considered terroristic. I then informed the officer that I was unaware that Kansas had laws defining terrorists as people who left voicemails at businesses after 1:30 am. I asked him for the statutes in the Kansas constitution or any recent amendments outlining these claims. I also informed the officer that I had just relocated to Lawrence KS from Oregon and that there was a 2 hour time difference & I was still adjusting to the new time zone. 8. While speaking with the officer, I asked if there was an incident number in case I decided to return to Overland Park to visit family and friends. He said no. 9. I contacted my bank, Chase Bank, to attempt to stop the charges from going through. I spent 3 1/2 hours with 2 different Customer Service Representatives trying to explain my situation. When I asked whether I could record those calls (even though the bank was doing so) they said no. In my first long call with the Customer Service Representative, she recommended trying to deal with & negotiate with the business in question. She also provided 2 other possible paths for recourse. 1. Contact the local Better Business Bureau 2. File a claim in Small Claims Court 10. Having spent many hours trying to negotiate with Voga Salon, providing pictures of my extisting hair (and the extensions which had already fallen out), documenting all details related to this purchase, experience and apparent services not rendered, along with multiple attempts to provide legitimate feedback on their website, I heard nothing. 11.Because of the stress related to this issue, I was forced to seek medical help for anxiety (that had returned due to this problem), a refill of my anti-depressant & anti-anxiety medications, meanwhile trying to find appropriate avenues for justice, options & resolution. 12. Despite repeated attempts to find a resolution to this impasse, I consulted an attorney, downloaded documentation needed to file a claim in Small Claims Court. I also tried to contact the Better Business Bureau but this business is not listed & could therefore not file a formal complaint. 13. Feeling helpless, I thought that I would be within my legal boundaries to engage in a one person, peaceful protest against the said business. Being concerned about the involvement of law enforcement, I contacted the following individuals: 1. The Overland Park Police Department 2. The local chapter of the ACLU 3. The Kansas City Star newspaper 4. The Lenexa Police Department 5. The Police Chief of Olathe, Lenexa, Overland Park to obtain the following information: 1. Which juristiction this business was located 2. What the KS laws were regarding peaceful protests & exercising my civil rights as a legal, law abiding, tax paying citizen 3. What the boundaries were for my peaceful protest 4. Whether or not I had to provide the business with advance notice 5. What law enforcement personnel needed to be informed of my protest I received the following information: 1. I was not allowed on any property that the building manager owned 2. It was not clear what the boundaries were for my peaceful protest 3. There was no guarantee that I would not be arrested 4. There were no clear guidelines that law enforcement personnel could define, articulate or explain to me. In the meantime, given that I am now afraid to leave my home, I did some research and found out through the Kansas State Board of Cosmetology that Voga Salon is not even licensed and that indeed their license has been denied & revoked. I trust that someone in your office can do the same research rather than requesting it from me. That revelation aside, my obvious desire to not be arrested (especially during the festive Thanksgiving season), I wisely chose to not engage in a peaceful protest. However, I have continued to pursue this injustice in anyway I can, while I have the energy, desire, motivation & concentration to do so. In my endless pursuit of justice, fairness, retribution & resolution, I have had to pay an additional $800.00 to get the initial product & service done correctly. As I simultaneously pursue experimental treatment for a life threatening illness. Although opinions, feelings & pontifications are not part of this submission, it has caused me enormous despair, paralyzing depression & existential angst that a disabled, terminally ill senior citizen must spend this limited amount of time left, enduring the humiliation of law enforcement, illegitimate businesses & spending hard earned money to incite someone to action. This is NOT what someone in my position should be required to do! Imagine if this were happening to your elderly mother. I would like to think that someone would feel compelled to either do their job, be inspired to take action or simply encourage some reasonable dialogue on a seemingly small problem. Of course, I would not waste your time, request your expertise & knowledgebase on a frivolous claim. I am well-versed in the rule of law, my ex-husband was Deputy Attorney General of the state of Oregon, I have successfully won 2 federal lawsuits against multi-national companies, etc. By all means Google me....And I have been educated in the importance, relevance & significance of detailed, fact based, documentation, evidence & information. So, of course, I have sufficient, current, detailed, legitimate documentation to support my case. Although I was born & raised in this great state, I will once again reiterate my deep & profound sadness at the unwillingness or inability of persons empowered to ensure the rule of law here in my home state. I am not sure that I will survive long enough to see this small injustice resolved. Again, my pontifications are warranted here as my inevitable premature death will no doubt be in part exaserbated by dealing with a SEEMINGLY, SMALL ISSUE that should be capable of resolution. If this is the state of things in Kansas, I will literally demand that I be transported to another state before I end my life. Living this way isn't living at all. I IMPLORE you to take action. For God's sake, someone needs to.
