Issue NOT resolved!
I've since reported to the USPTO about the unfair refusal of my mark. The USPTO replied to me in email stating no wrong doing was found on behalf of their attorney whom reviewed my trademark application and returned the refusal! Very unfair!
I filed my application for trademark with the US Patent and Trademark office and as a low income individual, sacrificed the 225.00 filing fee. After thoroughly reading through all the rules on self filing without help from an attorney, I was confident I had followed all the rules put forth and had to the best of my ability, completed all required evidence to accompany my application.
Four months after submitting my application, the attorney for the US Trademark and Patent Office contacted me by email to inform me that I had not submitted acceptable evidence that my trademark was in public use.
Oh, but I had submitted such evidence!... which was in the form of a web link to my online store (which I am desperately trying to get my website found on the enormous internet sea of website competitors) Nowhere in the rules did it state that what I submitted for proof was not acceptable proof. In fact, there's nothing better which I could have submitted for proof!
So, the attorney requested I submit acceptable proof (still not being specific as to exactly what type of evidence proof) and he further stated I would need to submit an additional 125.00 as a result of this. I responded that the web link to my website which I submitted was sufficient evidence of use and basically I didn't have another 125.00 laying around.
Two weeks later I got an email notification from the attorney which was refusal of my application - final.
I contacted the USPTO and told them the whole story and how my application was unfairly refused but their very quick reply was that there was no wrong done on their attorney's behalf.
My advice is if you are seeking a registered trademark, hire an attorney working on your side for you because the USPTO has their attorney working against you.
It shouldn't be this way and it's unfair to people like me unable to afford an attorney but unfortunately that's how it is. It's very sad they are treating people this way!
