To inform the physicians who are looking for malpractice insurance coverage
When I started my solo practice few years ago there were only 3 malpractice insurance companies that were available for the physicians in California who needed to purchase liability coverage. CAP-MPT, Doctors company and NorCal.
CAP-MPT rates were and still are the cheapest among these 3 companies for all specialties. I naturally chose CAP-MPT because this company offered the cheapest rate for my specialty. However I was not aware that the reason why their rates are so low is because the company does not provide defense for the doctors who are subject of malpractice lawsuit. Most insurance experts who are familiar with the malpractice companies who operate in California do tell you that CAP-MPT does not have claims made policy, which is what you believe you are buying from the company, the company actually has claims paid policy.
This is especially true if your specialty is a high risk specialty such as cardiac surgery, neurosurgery or OB/GYN. Their lawyers and executives will lie to you, harass you, insult you and force you to sign settlement with the plaintiff. If you object to how they have treated you they find a way to expel you as a policy holder. If you are expelled by a malpractice company as a policy holder you will have a very difficult time finding another insurance carrier to sell you a malpractice policy.
You will be very sorry that fell for their low rates in the first place. Remember there are no free lunches. If you become a subject of malpractice lawsuit you will not be able to save your reputation because their lawyers will take to the judge’s chamber and together with the judge will Harass, embarrass, abuse, insult and drag you through mud so much that you will be forced to settle mostly because you cannot see yourself going to a trial where the judge and the lawyer whose job is to represent you disrespect you and show low opinion of you.
Do your research on these insurance companies and do not fall for low rates. You will pay the price sooner or later.
