Verified Reviewer |Illegally auctioned of my storage unit
- - Storaway auctioned unit 022 with no notice or certified mail.
- - Florida law requires 14-day notice and certified mail; items must be returned.
Issue not resolved even though the BBB. If Stowaway Self Storage can email me invoice, and the day before the auction tion, then they could have emailed me with notification of the auction in time for me to get the money to pay the Storage so it didn't go to auction.
I did receive many emails with invoices, and the invoices said to pay the balance to avoid any more fees. There was no mention of the unit being auctioned off. The only time I was notified the unit was to be auctioned off was the day before the auction via email.
According to my research Florida law states, I must be notified of the auction 14 days before the auction takes place. I was notified only one day before.
Florida Law also states a certified letter must be sent to the last known address, with an attempt to obtain a current address if the letter is returned. The company had my email and never asked for any current mailing address. Florida law states any personal items like bank records, photos, tax records, etc., should be returned to the tenant of the storage unit. Nothing personal was returned to me, and now I have personal information out there for people to use.
I also found in my research, Florida Law states any money over what is owed should be given to the tenant of the unit.
The balance I owed was $558.77 and received a collection notice this month for $233.77, I dont believe the company only received $325.00 for the storage unit (022). I dont believe the amount Storaway Self Storage states they received because when the door of the unit is open there was visible furniture, appliances, electronics including 2 flat-screen TVs. There were also visible boxes marked CDs, DVDs, and Crystal. In addition, there were in the very front 3 Dell monitor boxes, which one alone retails for 2-3 thousand dollars.
The research I found legally stipulates that Storaway Self Storage stole my stuff and whoever bought the unit (022) bought stolen items.
I want my stuff returned or the monetary equivalent for replacing the items. Illegally auction
- Illegally auction off storage units
Preferred solution: Full refund
