Right Choice Transfer - Do Not Use Them

In October 2013 signed up with Right Choice Transfer to transfer my time share. Paid them $2,975.00.

RCT said it would take 6 to 9 months well it's been over a year now. December 2014 sent RCT my time share maintenance fees which they agree to pay. They said they are paying my particular time share maintenance fee. DO NOT DO BUSINESS WITH THIS COMPANY.

I have filed complaints with CA BBB and CA State Attorney General, My state Attorney General and the FTC. Can never get hold of anyone or can never get anyone to call you back.

Talked with a customer service rep once, sounded like she was working out of here house because the kids were playing in the back ground. I guess I can kiss my money good by.

Right Choice Transfer (timeshare title transfer company) is a FRAUD

Right Choice Transfer (timeshare title transfer company) is a FRAUD
Updated by user Apr 21, 2014

I guess I need to apologize for my previous diatribe against Right Choice Transfer. For the longest time, I believed this company was legitimate, but Right Choice Transfer does business under several names; Timeshare Relief, Transfer Smart, Pacific Transfer, Transfer on the-Spot, Timeshare Cure, Donate Title, Transfer America…there are approximately 20 entities in all.

All were created by the same individual, David MacMillian, all share the same few phone numbers and all addresses are located on 190th St Torrance, CA. The CA Attorney Generals office told me that 224* ***th St was not a “brick and mortar” building and does not exist. It is a shell company, which explains why they took the money and are now unattainable.

While RCT technically does not require a real estate license to operate, they “promise and agree to designate a licensed third-party” to make the transfers.

Herein lies the problem, they are delegating “subcontractors” that are NOT licensed. In our case RCT transferred us to two subcontractors, The Timeshare Company and then In Less Time Closings, however, when I called the Wisconsin and Ohio Bureau of Real Estate they could not find licenses for these companies. So even if TCC or ILTC WANTED to transfer our title, they could not do it legally. And the fact that they did not request a POA from us proves they never had intention to do so.

The only company that does have a license is Pacific Transfer, but they also have an F rating with the BBB.

At least one company (Transfer Smart) has Desist and Refrain orders from CA Bureau of Real Estate and Donate Title is under investigation by Connecticut AG as of June 2013. Timeshare Relief Now paid almost $14K fine for noncompliance of the Indiana Deceptive Consumer Sales Act in 2012. A number of these companies have lengthy alerts/warnings issued by the BBB.

As of this time, after speaking with a lawyer, our only recourse is to file in Small Claims court, which is unlikely to be successful because of location and jurisdiction and the fact that the defendant (if you can track him down) will not appear in court. If you have been a victim, please file a complaint with the FTC and your AG so we can bring these guys to trial.

Original review Mar 25, 2014

On 11/20/2012 we paid Right Choice Transfer (RCT) almost $4000 to transfer our timeshare title. The process was suggested to take 6-9 months. Over the course of 16 months RCT transferred our file to three different subcontractors, none have been successful and we are in title clearing with the third subcontractor. In Feb 2014 I received our annual maintenance bill from our resort. RCT refused to pay it. They alleged that original paperwork (from 2012) was not returned to the first subcontractor within stipulated timeframe per contract. Even after faxing UPS tracking/certified mail slip proving documents were received within timeframe, RCT refused to pay or make contact with us and making contact with RCT is excruciating and time consuming. We were on hold for DAYS (one day 13 hours) only to be hung up on or transferred to VM despite imploring to speak with a human. No VM messages were returned, including calls placed to our “personal representative” Tyler Courtad. On 03/25/2014 I called subcontractor for update and they informed me they were “having issues with the resort” so completion of our file ETA……2-4 YEARS!!!

This complaint was filed with LA BBB for breach of contract but RCT did not respond. I have also filed complaints with the FTC for fraud and CA attorney General. See my video on youtube. https://www.youtube.com/watch?v=F1sVemW2M_M

RCT is employing fraudulent business tactics (fraud in the inducement): RCT advertizes A+ rating with the BBB, but actual rating is F. RCT states “time is of the essence” which implies quick execution of process…how can they promise this when they refuse to communicate? RCT creates urgency to sign contract by stating “at any moment your resort could be added to the dreaded “cannot get out of” list. RCT promises full refund if unable to execute transfer. This is deceptive and a misrepresentation; RCT can drag out process for years without being in breach of contract with no intention or obligation to refund monies.

Fraud and deceptive trade practices: RCT’s blatant and flagrant refusal to communicate with client inhibits consumer’s right to obtain information and/or to enforce a contract. I was on hold for days (one day for 13 hours) only to be hung up on or transferred to VM despite imploring to speak with a human. No VM messages were returned. RCT does not provide customer with written contract prior to payment. While this complies with TSR Section 310.3(a)(1), I believe RCT chose to withhold written contract and utilized oral disclosure in an effort to misrepresent some aspects of the contract (a violation of TSR Section 310.3(a)(2)(iii)?). RCT falsifies dates in which documents are received to avoid financial obligation.
