Financial Ombudsman Service - PPI claim with all the classic mis-selling clues but ruled out

Update by user Jul 25, 2018

Update: Just got another PPI ruling from the emanent gents at FOS (yes, spelled correctly!) Apparently, I would have needed PPI to cover £10 a month for 12 months, on my £33,000 job and wife's £28,000 salary. Jeez!

I could have *** out more money in one go! Where on Earth do they get these ombudsmen? Unbelievable is not the word!

How is anyone supposed to get justice when there are "people" making decisions like these? .

Financial Ombudsman maintains position that keeping PPI secret, not needing it or knowing about it, overcharging (Plevin) relative to others and selling by untrained personnel at a shop counter completely without any advice whatsoever - is all OK and was not mis-selling! With such a bizarre and unaccountable ruling, it is impossible to take the case any further and get even a sliver of justice.

Launched a PPI claim "blitz" in Winter (78 accounts, most came back no PPI). However, several came back as taken over/purchased by a well known high street bank with 'questionable customer appeal; who, as a standard practice, deny all PPI claims. In one case, dating back to 2003, probably 5 years before ANYONE had ever heard of PPI, a card application succeeded and along the way, signatures were requested in several boxes entirely without explanation, by an untrained counter person, not qualified in selling insurance, not even mentioning PPI or what the one-off £9:99p fee was for nor the higher rate of interest (Plevin), not asking if any insurance were wanted or needed, and so on. The Ombudsman ruled all that was NOT mis-selling. At the time, the applicant had been in stable employment for 7 years at the same company, salary £33,000pa, at least 3 onths sickpay, at least 3 months savings and total spend EVER on the card account was £94. The Ombudsman ruled that the applicant would have wanted and needed the insurance "if you had known about it". Incredible! We estimate about 200 times the total repayment money that was available and yet the ruling was insurance was needed! When the card account was taken over by the bank, no information was provided at the time or till present day and no hint was given that there could be potential implications for PPI. The Ombudsman did not mention this aspect at all. The Ombudsman dismissed any possible Plevin claim for reasons that we did not understand (sic!) but did not mention the age of the account in context of the deadline for Plevin claims - unbelievable! Now, the actual value of our PPI claim was low, probably negligible but the process demonstrates how little faith can be placed in obtaining justice through the Financial Ombudsman service. In our case, we know at least one more card account sold onto the same bank - there may be more. We are not holding our breath for fairness and despair of this country and its so-called justice.

TripAdvisor - Dictatorial, uncontactable, incompetent, possibly illegal

Update by user Jul 11, 2018

Trip Advisor still refusing to answer any questions about the alleged offending review from 10 years ago, probably because it never existed (nobody here had an account then and we had no staff till years later!) They still have us listed below correct ranking position but then, that gives them a good excuse to illegally boost competitors who pay more in commission. The CMA is warning companies like Trip Advisor about exactly this kind of thing and they may impose gigantic fines (we hope!) Trip Advisor still cannot be contacted about a billing issue, where we believe we have overpaid AND they seem to have charged us false bills on too many occasions. Are they run by Mafia (or the Irish Mob, since it is Boston?)

Main complaint: Sudden email telling us our business was being penalised for some undisclosed reason, accompanied with a lengthy statement from "Content Integrity Team" about fake reviews. THey stated it was only possible to contact trip advisor through them (yeah, 100,000's of folk been trying to complain to trip advisor for a decade or more!) We replied asking what the problem was and their reply was a review from over 9 years ago did not comply with their guidelines but still did not provide any information. They stated we needed to initiate staff training procedures and they might consider speeding up the mitigation of penalties......Training about what! - they still did not tell us! We replied again and pointed out that probably under Data Protection Act and Companies Act and definitely under GDPR they are legally required to provide the information they used to reach their decision and detailed reasoning behind the decision. We feel their refusal to explain themselves or to provide even a scrap of evidence in support falls under "unfair trading" so we said we would report them to Trading Standards as a first step. Trading Standards have indeed agreed to investigate (but we are not hopeful - trip advisor can afford lawyers paid more than the UK PM!) Worst of all, in our minds, is that they left it "over 9 years" out of 100 reviews - so why not contact us 9 years ago? Why not ask us about the review? Why just immediately act in a manner that will impact our business finances, despite not being a legally empowered authority and acting solely under Boston - Massachussets Laws - as they clearly state in their terms and conditions. - therefore out of jurisdiction here in Europe. We also have a minor discrepancy in billing amounts, dates and number of bills and find it is totally impossible to make a simple billing enquiry. Utterly infuriating and totally unprofessional. We have closed out personal account, paused our booking account and now await Trading Standards, before possibly passing this to EU GDPR Commissioner Margrethe Vestager and others for their edification. How can a hige company become such a bunch of shabby, crooked little Hitlers, refuse any and all attempts at protest or complaint or any contact at all and seemingly get away with it? It beggars belief!

So whiney princess google cannot stand a bit of criticism. THey asked for legal reasons to remove the fake review, which we gave them.

In return, they labelled our complaints as spam and proceeded to close all our google accounts. Including our you tube account which...
