Fraudulent foreclosure void judgment federal law violations

stars-rating-full stars-rating-full stars-rating-full stars-rating-full stars-rating-full

In 2009, PHH Mortgage Corporation, through its predecessor *** Loan Servicing LP, foreclosed on my home at ***, using a void judgment entered in the name of LaSalle Bank, dead eleven months before the judgment. The assignment was signed by Aames Funding Corporation, dissolved 17 months before execution, confirmed by California and Florida government records.

The assignment was prepared by *** and ***, ***, connected to DocX LLC, whose founder, ***, was federally convicted and sentenced to 58 months for forging mortgage assignments nationwide. *** own assistant vice president admitted under oath they knowingly used dissolved *** for convenience, not legal authority. Bank of America and *** were discharged as unsecured creditors in federal bankruptcy court May 10, 2011, then signed a deed as secured trustee three months later, violating 11 USC Section 524. The FBI confirmed I reported this fraud May 9, 2009, four months before the void judgment.

PHH has responded to every CFPB complaint, stating the request is untimely.

There is no statute of limitations on a void judgment. No substantive response in 17 years.

Loss:
$200935
Cons:
  • Void foreclosure sworn confession of fraud federal bankruptcy discharge violation

Preferred solution: Full financial restitution for void foreclosure of $200,935.88 plus 16 years of consequential damages

Professional agents

stars-rating-full stars-rating-full stars-rating-full stars-rating-full stars-rating-full
AI Highlights
  • - Escrow increased payments by $100 monthly, not disclosed.
  • - I canceled the extra $200/month to principal; the agent was professional.

Was never informed that my mortgage payments were going up to $100 a month due to Escrow issues with increased property taxes and homeowners insurance. And I never received information regarding the increase in my homeowners insurance.

It was just lucky that I was sending in an extra $200 to principal which covered the increase in the monthly mortgage payments. And I went online to cancel the $200 a month extra two principal.

So it worked out good. And the agent I spoke with whose name I did not get was very professional knowledgeable patient polite and the pleasure to work with.

Check you sent me to get my roof done. You guys signed a bill of the line so that my bank cannot cash it or Chase Bank cannot cash it because they went below the line, so you'll have to send me a new check.

They stole from us

stars-rating-full stars-rating-full stars-rating-full stars-rating-full stars-rating-full
AI Highlights
  • - Fell behind on payments and faced foreclosure.
  • - Property managers allegedly broke in and stole about $25,000 of belongings.

We'd fallen behind on our payments and were threatened with foreclosure. They sent property managers to break in to the property (which is a vacation home) and they stole roughly $25,000 worth of property including snowmobiles, shop tools, mountain bikes and, various other items. I'm not defending our financial hardship however, they don't have the right to steal from us.

User's recommendation: There's no way to avoid them buying your mortgage but, you can prepare yourself from being stolen from.

Concerned

I'm happy with the outcome of my experience with them so far. I'm not familiar with this company enough to answer this question in any other way at this time.

I would like more experience with them in order to say more.

Customer service was very nice and helpful in our conversation. I expect the same in the future.
