He took our money and didn't deliver

I wrote him a check on 8/29/23 for $16,824,00 for a material deposit. He promised the building would be completed by the end of November. He came November the 15th, 2023 to lay out the building. At that time I decided to *** an additional 20' in length to the building adding $8000.00 to the cost.
He requested I write him and additional check for $8000.00 for the additional material which I did. He promised adding the 20' would not make it take any longer. This makes a total of $24,824.00 I have given him. His crew showed up December 6th & 7th.
They installed the poles and trusses on those days. He does not show back up after many lie and promises that they are "on the way". I noticed 8th the building had many warped purlins and the entire structure was shifted to one side. At that time I called and fired him for all the lies and shotty construction.
I told him if he would pay me back $13,398.00 I would just forget it. After many lies and broken promises he has not paid me a dime. I hired a new contractor to finish his mess and it cost me $20,574.00 to complete. My original cost was to be $32,000 on the completed 40x80 three sided building.
After paying him a $24,824.00 deposit and paying the new contractor $20,574.00 I now have $45,422.00 in the building.
He has not paid the $13,398.00. I hope this doesn't happen to someone else.
