Buyer beware - Stay away from Mr Diamonds USA, NYC

On 1 April 2016 my girlfriend and I flew to NYC to take in the sites and frequent the Diamond District to look for engagement rings. Our 2nd stop was Mr Diamonds USA. Initial experience was fine but thought it was odd we were passed 2 times around by the sales persons. i think as they qualify you, they progressivly pass you to the next sales person. We did find a ring and made it crystal clear we were going to continue looking for other options at other stores in the district. They even asked where else i was planning to go.. Then the pressure started with..this is last one...best deal..etc. However. We did like it...but still felt compelled to look around. Finally, we decided to put down a deposit to "hold" the ring. Again, oursales person knew we were still going to look around. Never explaining that the store policy was any deposit was as good as a sale. Apparently there is a sign posted that All Sales Final. Fact is. This was a deposit, they knew that, and had a responsibility to reconfirm their policy, but did not. Sad business practice in my book. How about Sir, if you put down a deposit, store policy is no refunds. Never happened.. Additionally. There was never a Bill of Sale delivered to me. Only a credit card receipt..this confirmed what i thought was not a sale but deposit. We left the store and continued to look around other stores. We returend to TN where we decided to have a ring custom designed. So i called Mr Diamonds and told my salesperson of our decision. This was April 1oth. Less that 2 weeks from visiting the store. Salesperson started the high pressure tactics again, but we firmly reminded her that was a deposit and she was infact aware thats all that was. She agreed and said it would take a billing cycle to post. 30 days later no credit. So i called back. This time is was the manager/owner who basically told me no way i was getting my money back. Roman is one of the most unprofessional business people i have ever dealt with. Being a retired military officer, I have seen alot in my time. NOBODY tops Roman. He is as rude and arrogant a person i know. All friendly when the customer is in store, but different personality otherwise. I contacted my credit card company. They only looked into the transaction nothing else and since there was no issue with transaction they could not help me and suggested I contact NYC Consumer Protection Division. That was next step after Roman stated he would not even give me a store credit. Basically, Roman and Mr Diamonds STOLE my money. NYC CPA reviewed store policies and credit card receipt for compliance. We requested Bill of Sale again,still none was submitted to us.Since the receipt had All Sales Final...which was below the signature line, law states it has to be above, only thing we could do was go to small claims court. Living in TN, Roman knew it would cost me more that the deposit I put down. i was willing to pay restocking fee or other agreement to settle issue. Roman still refused and even threatened me with a law suite. I contacted an Attorney and it was evident it would cost me more to fight this than the 5K DEPOSIT I delivered in good conscience. Still Roman refuses a store credit and this is nothing but theft. Last resort is to inform others of these shady busines practices by Mr Diamonds. i have even entertained going on a show like Judge Judy to expose them for stealing my money. The last comment from Roman was that I had buyers remorse and couldent afford the ring in first place. Roman, hate to burst your bubble....be happy to show you the fine custom ring i did buy. Suppose your business is not a profitable as you claim as you have to steal $5000 from a Retired Disabled Veteran. Provide NO store credit, threaten me, insult me, as your nothing but a thief. Guess you need the money more than me. i even bet you no longer have the ring and have since sold it. Buyers beware..........many reviews on this company.
