Sold me a RAV4 with contract that has been sold already, with the intention to not fulfill their end of the deal.

This dealership is running scam. Dealership sales employees and general managers internationally misrepresents their cars availability and fraudulently are selling same vehicle (same VIN) to multiple customers by filing paperwork, running credit checks, receiving monetary advancements only to later ask customer to purchase alternatives expensive choices by claiming it is a common thing in their dealership to mislead multiple customer into purchasing the same vehicle.

Dealership managers show no remorse for the customers trouble, are incompetent and does not properly train sales employees.

I have received terrible customer service and consistent misrepresentation from the employees of the Mike Calvert Toyota dealership. My family members and I had visited the Mike Calvert Toyota dealership to purchase a brand new Toyota RAV4 on Friday August 29th, 2025.

Prior to visiting the dealership I had personally called the dealership on Thursday August 28th around 6 pm to confirm availability of a 2025 RAV4 with sales employee Javier Seanz. He claimed the car with the exact stock number was available at their dealership. On the 29th, when my family and I arrived at the dealership in the afternoon around 3 pm, Javier informed that same stock is no longer available.

Javier had my personal phone number, but failed to inform me via text that the same vehicle is no longer available prior my arrival. This is a misrepresentation from the dealerships to get the customer in the door while having the knowledge regarding the availability of same vehicle. Their tactic is to use the scarcity to push a relatively expensive alternate to unsuspecting customer.

Javier then proceeded show one vehicle of similar yet more expensive quality claiming this was the only available ones in the price range. My family queried about two RAV4 vehicles that are similar price ranges to our original inquiry, which the dealership website still showed available.

Still, Javier informed us those vehicles are not available. Why then does their own dealership website still showcased the same vehicles on August 29th? Is this not misleading to unsuspecting customers? This tactic to waste customers time and energy is truly disturbing.

The illegal action of the dealership sales employee Javier and sales manager took was to have my family sign a contract, run our credit, and receive a monetary payment on a vehicle which was already sold to another customer.

Neither sales person nor their manager had mentioned to us this was a sold vehicle.

The disbelief on my families face when we arrived on Saturday August 30th was undeniable. After negotiating a specific RAV4 vehicle we decided to go ahead and purchase on august 29th. While on the test drive, the my family noticed a sold signage inside the vehicle, and while asked, Javier assured us this was a mistake and the vehicle was still available to sell. We requested he check with his manager as we are only interested in vehicle that are available to sell.

After the test drive, my family and the dealership came into agreement, and the dealership required to have the contract drawn up same evening; we were asked to have credit ran for the $$$$ dollar loan, and $$$$ dollar down payment on the august 29th. We agreed to come back on august 30th with the remaining $$$$$ dollar cashiers check down payment as at the time of the deal on 29th it was past bank hours. Dealership accepted and we met with finance manager Danny who worked on the purchase contract, ran our credit score for financing, and processed all the paperwork electronically. We paid $$$$ dollar using debit card, and received the contract and related documents in a flash drive.

During this time we were not informed by the Javier, or his manager that we are buying an already sold car. We went through the entire process for approximately 4 hours and returned home with all the documents and purchase contracts. Next day on august 30th when we went to the dealership to pick up our car and pay the remaining $$$$$ dollar payment, Javier informed that there has been a misunderstanding and that the dealership sold us a RAV4 that has already been sold before to another customer.

My family and I were so disappointed and upset given the circumstances. We requested to speak with Javiers manager and a general manager name Jose D.

came to handle the situation. The solution the general manager proceeds to provide us is another vehicle of relatively higher cost, or wait a week for a similar vehicle. When asked for explanation, general manager Jose states this is a common thing that happens in their dealership. In the past ten years while purchasing multiple Toyota vehicles from several other dealership, this has never once occurred to my family.

Also, to state this as a common occurrence only speaks volume to their incompetence. They are conducting business in a fraudulent manner with no repercussions. After trying to pass of a similar car with incomplete interior finishing on the side doors, we were provided the option to purchase a higher priced car. When we refused the dealership simply refunded the $$$$ dollar we paid with no other resolution.

They did not provide any resolution to the fact they created a contract and failed to provide the vehicle as stated in the contract, and ran our credits, took our personal information, time and energy.

My family and I are extremely dissatisfied and feel the dealership simply tried to shrug us off as female buyers. The dealership management has yet to take any appropriate steps. We are seeking justice for their actions. They purposefully held off information prior our arrival on both august 29th and 30th.

The dealership has tendency to misrepresent and lacks ethics in their business practices. They did not provide any restitutions for the fact they created a contract fraudulently and ran credit with the intention not fulfill their end of the bargain.c
