MedShift's Misleading Claims, Breach of Contract, and Predatory Litigation
My experience with MedShift has been an absolute nightmare from start to finish. I was initially approached by a sales representative for their facial machinesdespite MedShifts claim that they dont have a sales forcewho assured me that their machines were "more advanced and superior to HydraFacial and Jet Peel." The representative provided me with price points and profitability projections that were completely unrealistic and impossible to achieve.
After quickly realizing that these promises were false and that the machines were far inferior, I knew I had been misled.
I immediately reached out to MedShift to resolve the situation. For months, we went back and forth, with me repeatedly expressing concerns, highlighting the misleading claims, and requesting that MedShift take back their equipment, which remained unopened and completely unused. Eventually, after significant frustration and months of communication, MedShift finally picked up their machines from my house. The equipment was completely unused, unopened, and still in its original packaging, fully resalable at its original market value.
At no pointbefore, during, or immediately after retrieving the machinesdid MedShift assert or mention any balance owed. Their representative even thanked me at the time, giving every impression the matter was fully resolved.
Shockingly, after 18 months of absolute silence, MedShift abruptly filed a lawsuit against me, seeking payment without warning. They failed to follow their own contractual procedures by not providing the required written notice of default and the mandatory 15-day cure period stated in their agreement. Furthermore, MedShift served legal papers at outdated and incorrect addresses, which prevented me from receiving proper notice and responding in time.
Their lawyer then misled me during a phone call, stating that the amount in their claim was simply the total cost of the machines, not necessarily the amount they were pursuing.
I was told they would clarify with MedShift and follow up, leading me to believe no immediate legal response was necessary. Instead, MedShift moved forward aggressively and obtained a summary judgment against me by exploiting procedural loopholes and my temporary inability to respond due to personal circumstances.
At a recent court hearingwhich my lawyer attended on my behalfthere were four other MedShift cases scheduled at the same time. This suggests to me that my situation is not unique but part of a broader pattern in how MedShift operates.
MedShifts Pattern of Retaliation and Harassment
Rather than addressing customer concerns professionally, MedShift has repeatedly demonstrated a pattern of retaliatory and bad-faith behavior. After I left a 100% truthful review on BBB, instead of responding to my concerns or defending their practices, MedShift resorted to personal attacks, posting articles about my legal history in an attempt to discredit me rather than address the substance of my complaint.
As if that werent enough, MedShift has also threatened file another lawsuit against me for defamation over a review that is entirely factual and based on my firsthand experience.
This is nothing more than a blatant intimidation tactic meant to silence criticism and prevent others from speaking out.
Instead of standing behind their products and business practices, they would rather harass, discredit, and legally threaten dissatisfied customers.
This response only reinforces what I have dealt with for over two years: a company that relies on deception, lawsuits, and intimidation instead of ethical business practices and accountability.
BOTTOM LINE:
Based on my experience, MedShift misleads customers into signing contracts, ignores its own contractual obligations, and relies on aggressive legal tactics and intimidation to profit unjustly from unsuspecting businesses. From misleading sales tactics to lawsuits, legal threats, and public retaliationmakes it clear that they cannot be trusted.
