Fraudulently listed my car for sale

I went in to a Morgan auto group company, Mazda of Fort Myers, on Saturday 11/16/2024. I knew exactly which car I wanted to take for a test drive and on the recommendation of a friend I asked for Victoria.

She got the car that I was asking about and we took it for a test drive, during which she confirmed that the price of the vehicle I saw on Carfax was indeed the price of the vehicle.

At no time did she offer any explanation that depending on financing the price would be different. I asked her if I would be able to take the car to show a family member as they were at a funeral, she volunteered to allow me to have the car for a 24 hour overnight test drive. I told her I would be back at the dealership Sunday 11/17/2024 around 12 oclock noon to move forward with the sale process.

And I arrived Sunday afternoon approximately around 12 oclock, Victoria was running late.

Her service manager Rodrigo asked us to sit down and she would be there shortly. Victoria arrived, and we started discussing the price of the vehicle.

She also had someone come out and value my vehicle. Victoria asked about down payment, and I told her I would determine how much I was going to put down once I knew the price of the vehicle.

Again, she verified the price of the vehicle that was listed on the Carfax. I asked about some items that were listed as being on the vehicle and she stated that her manager would have to look into that, which I was later told that the descriptions are generated by someone else, and that this was a used vehicle and not all the options were still on it. Mind you, this was a 2024 GMC terrain with only 7 miles on it.

So I had a very hard time understanding how this was owned by anyone and how any items would be missing.

When Victoria returned and wanted to nail down payments and financing, I informed her I already had my own financing through USAA. She said she would have to talk to her manager again. She returned and informed me that approximately two weeks ago they have decided they no longer work with USAA financing. But they would run my credit to see if I would qualify for one of theirs as that would be the only way to get the advertised price.

Again, I stated that it did not say anything about dealer on the Carfax site.

After waiting about four hours, without seeing a single person or being asked if we needed anything for almost an hour and a half, I decided I no longer wanted to purchase this vehicle from this dealership. I walked next-door to the Subaru dealership and asked him if they would honor the price, and get me out of the door in the next 30 minutes. They assured me they could.

And then I was told that the sales manager at Mazda was the best friend of the sales manager at Subaru and I would have to therefore buy the car from Matt Mazda and give Victoria the sales credit because she worked so hard. At no time did Victoria put any effort into the sale.

I approached her, I told her which vehicle I wanted and how much I was willing to pay. I told her point-blank I had cash to put down and I had my own financing.

There was no actual hard work done on her behalf. I said that I felt that this was a bait and switch situation where they use the price in the advertisement on Carfax to bring a customer into their dealership, only to jack up the price when they dont use their own financing or if they pay for the vehicle by cash. I walked out and told him I was no longer interested in purchasing this vehicle.

During this time over the four hours, at no time did I sign over or relinquish my own vehicle.

Imagine my surprise when four days later I see my car is listed for sale on their website and on Carfax.

When I called and spoke with Rodrigo, he began to insinuate that they were waiting for me to come back to purchase that vehicle. I had a hard time understanding the vehicle I was looking at was still listed for sale, but was now a higher price.

I told Rodrigo I wanted my car removed off their website immediately, and I also wanted it removed off of Carfax.

He stated he would get it done immediately and that I would have nothing to worry about. Six hours later, my car is still showing as being sold by the Mazda of Fort Myers, which is part of the Morgan auto group , and I have never in any shape or form given consent or permission or authorization for them to list the car I own as for sale by their business

Preferred solution: An apology, and my vehicle to be removed off their websites as being for sale. And to be removed off Carfax removing the entry dated 11/17/2024 as the vehicle being offered for sale.
