My name is Nikita Romero, and I am a client of Mark Spain Real Estate in the DFW market. My property at:

5618 Boca Raton Blvd Apt 143, Fort Worth, TX 76112

was scheduled to close today.

However, I was just informed by my agent that I would need to bring unexpected funds out of pocket to cover additional commission charges. This was never disclosed to me at any point prior to today. Our initial closing date was last Friday and even then, there wasnt any kind of expectation set.

As you can imagine, this last-minute demand has derailed my closing. I entered into the transaction based on the clear understanding that I would not incur out-of-pocket costs beyond what was specified in the listing agreement (Section 5: Broker Compensation).

I also communicated this stance repeatedly to my agent.

I am requesting the following:1.A direct explanation as to why this was not disclosed or managed properly.2.Clarification of the brokerages policy regarding communication of commission obligations to clients.3.Immediate steps that will be taken to ensure accountability for how this situation was handled.

Throughout this whole transaction, the transparency, communication and expectations have been very misleading.

If I had the funds I would have closed on a traditional sale and not a subject to. This experience has caused me unnecessary stress, financial disruption, and the loss of a transaction that should have been handled transparently from the beginning.

Please confirm receipt of this email and provide a direct contact for the supervising broker so we can discuss this matter further.

On April 8, I told my agent, due to the problems I was having with him and his supervisor, I wanted another agent assigned. He responded he would let his supervisor know and get back to me.

As of today, I have heard nothing! I want my contract terminated immediately, with no monetary obligations or penalties to me.

I've already filed a complaint with the BBB, which you chose to ignore. If need be, I will pursue legal action.

I have reached out to the Corporate office of Mark Spain 7 times and spoke with them 7 times with the promise of someone from there to call me back. No one has to this date. They allowed the listing agent of the Orlando office to get away with the illegal practice and to not reach back out to me to try and resolve it.

I had put in an offer to the below address 2804 Mango Tree Dr, Edgewater, FL 32141 MLS# 100**** with my agent to the listing agent Tim Creson from Mark Spain Real Estate, Mr. Creson then released my offer letter to other unauthorized realtors in order to get higher bids from in which is not allowed in the State of Florida without my consent. You will take note to the below attached file that is a text message from Time Creson to an unauthorized agent releasing my offer letter without me authorizing just to get a higher bidder.

Preferred solution: Tim Creson to be fired from Mark Spain Real Estate and for my bid to be handled in a professional matter and this matter be reported to F.R.E.C. ASAP.

Mark spain is the devil. A con man. Thief.

Mark Spain is a con artist. He steals money from his agents and from all the customers and anyone he does business with.

His business model is based on Baden switch whether you're a seller or a buyer and the only guarantee he offers is that you are guaranteed to lose a lot of money by doing business with him. Get a real realtor. Find a trusted local realtor in your area and stay away from any company would operate like Mark Spain. The cash offer program is a scam as you will be offered $65,000 - $120,000 less than what it's worth.

They use the guaranteed offer to get you to sign a listing agreement with their agents. Or if you're a sucker and go for their offer then you get conned and lose all that equity to Mark Spain. Then if you're selling the agents just put your home in the MLS and do nothing. 3.5% plus of 495 administration fee is much higher than local agents and they do less to no work.

Remember Realtors do not write contracts and don't do any work. They just list your home in MLS and then it's up to you to Market your own property. They also convinced you the home it's worth less than it is to get it to sell fast so they can make quick money which results in you selling your home for Less when you could have got more and you lose money. No matter what you do you lose money.

Any program or business deal offered by Mark Spain has a cash and you will get scammed no matter what type of deal it is. The pure evil in this man and he represents himself as a good Christian, is insanity improves how satanic he is to pray on good Christian people in the community

STAY AWAY!!!!

In December we called the company to see how they could help us sell our home. We did not sign with them right away but in January, decided to give them our business.

We signed up and they listed our home on all the major websites. We received a lot of traffic and thought our home would sell quickly. We never heard back from the offers. Thinking it was weird, we contacted the agent.

The agent lied to us and said no one returned his calls. We know it was a lie because one of the offers was from our neighbor.

Fast forward, the agent himself ghosted us a few days later. The agent never left the company, and the next agent showed no interest in selling our home. We were told that no one was interested in our home, and she would call us in a week.

The problem with that was we were in a time crunch and needed to sell quickly. We then replaced her with a third person from the company. He told us that no one was interested in the house and gave us an extremely low-ball offer. The offer was over 100,000 less than the list price.

This is unacceptable.

If a company did this to a disabled veteran, they will do it to you too. STAY AWAY!!!

I can only comment on what you post. So if you do not post the whole story, you are making a narrative that suits you and leaves out details. Add in a claim of an undocumented $100,000 loss and you come across as dishonest.

This must be someone from Mark Spain because I tried submitting an offer and the agent wanted to send my offer letter to other agents first. You are a corrupt company and trust me I'm not done with you yet

I was listed with Mark Spain Realty they told I would get a same day offer and never got one 21 later I decided to pull the listing after hearing him on radio and TV he was a crock story

I listed my house with Mark Spain Realty on September 8. The listing didnt go on live until September 11 after hearing Mark Spain on the radio and TV several times about the same day cash offer never got one I was on the listing for 20 days exactly kept on getting pacified with talking to supervisors and regional managers, after Ive called the company three times and asked to personally speak to Mark Spain. He never returned a call back to me as far as Im concerned they are nothing but a crock of balls, and from what Ive heard from other people, they only give you real lowball offers from investors that do call when they call , their anywhere between 50 and $60,000 less than what youre asking for your home about the same as any other investors that are out there to try to steal your house and then put it back on the market to try to get the retail value for it Not a company to be dealt with also found out that the broker came from another state in North Carolina not in Florida

What a waste of time

mark spain is a classic bait and switch. out of the gate their offer range is acceptable then an agent comes out to inspect and hustle for listings.

they finally make a low ball offer and all their excuses why. no where near range originally offered

BAD experience selling through Mark Spain

We hired this company to sell our home in Spring Hill, FL. We just wanted a cash offer but was "talked" in to listing.

We were lied to by our realtor, Kathleen Cotton,She brought us an offer, $25,000 less than the listing price and urged us to take it because the buyers offer included no appraisal. Being a realtor she absolutely knew that wasn't even possible since it's up to the lender and not the buyer weather or not to get an appraisal. She sent the contract over and I asked if this stipulated "no appraisal" she lied again when she said she was sending an addendum stating there would be no appraisal. She NEVER sent it.

The lender ordered an appraisal but she wouldn't tell me what it came back at. We feel lied to and cheated.

I would recommend everyone stay away from this unethical company. If negative stars were an option they would get 5 negative stars

I was excited to be hired on with MSRE in the beginning. Eight months later I have parted ways with this Ponzi scheme.

Not only did they lie in published documents related to hiring but they also lied about listing my personal home. In short, its all lies. Don't believe one single utterance from this so claimed real estate company.

They do not value ANYTHING except the almighty dollar. Agent, Seller and Buyer BEWARE!

Where Are My Keys???

No one from the Mark Spain group was present to give us our keys at closing. After waiting 2 days for the keys to our own home, we had to hire a locksmith to re-key 5 doors and remove the lock boxes at the cost of over $400.00.

Thanks for nothing Mark Spain!! (By the way, I tried contacting the Mark Spain group to give them a chance to solve this problem before I made this review)

Opendoor who was partnered with MSRE when they hired me has been sued and found guilty for 62M in FRAUD for unethical dealings with SELLERS. I have an attorney in fact my father was one for a university in in Florida as is my fiance and best friend. They will GLADLY show MSRE where they went wrong.

I took a position with MSRE in Florida 2021 - I have worked in the industry for 20 years and licensed as a mortgage lender and sales agent. I have seen MANY scams in Florida since I started my career in 2002.

He and his "team" came into our Market with Opendoor and started heavily marketing distressed owners and properties you realize this AFTER you work for them how they get their business. Then the latched onto Agents and used my MLS, experience and Board to sell the properties and TRAIN their entire TEAMS from Georgia and the Philippines IE CHEAP UNLICENSED LABOR. Support staff were UNEDUCATED about Real Estate and Florida markets and from the Phillipines unlicensed. They made numerous ethical and fraudulent mistakes in the contracts and listings to the Florida NEFAR BOARD AND MLS under my licensing.

They hired me in November 2021 and Fired me in March 2022 for standing up to their unethical behavior and constant LEGAL mistakes. Heres the worst part. They promised me 25 Listings a month and a commission amount for each one I listed. I worked 24 x 7 in a PANIC buying market created in part by MSRE and never received 25 deals until the WEEK they fired me.

I was paid 5600 after I asked to be paid for my time my licensing and my pending contracts and listings. 5600 vs 15K a month. TOTAL AND COMPLETE SCAM.

They have ruined my career health and relationships. Im 35K in the debt hole and cant pay my bills.

I strongly recommend against senior citizens dealing with Mark Spain Real Estate.

Thursday September 30, 2021, 2pm appointment

I called Mark Spain because the radio ad stay led me to believe I would receive a guaranteed cash offer to buy my house. I spent the two days before my appointment spiffing up my house, its not very fancy, but it has been my residence for over 40 years.

I cleaned, painted, mowed and trimmed and greeted the agent with a cold bottle of water.

I proudly showed the dimensions inside and outside, improvements I have made, pointed out locations of sewer and water lines for future additions of bedrooms and bathrooms if desired, and tried to include everything I knew about the property.

I expected the agent would crawl under a sink, look in the attic, slam some doors, maybe check a measurement or two. I had a number in my head that if offered, I would start packing.

Imagine my surprise when Im told that I must sign a contract before an offer is made! Wait a minute! Sign a contract?

Before I am told how much it will be? The first thing I thought of is BAIT AND SWITCH! Then I thought that a contract that is being sprung upon me with no warning has been probably written by a herd of sleazy lawyers, and I had better have my lawyers read it for my protection. But I didnt have any lawyers standing at my side.

I suddenly felt deceived, preyed upon!

I felt, as a senior citizen, that this agent is looking to see if I have Alzheimers / Dementia, to steal my house for a penny on the dollar. I became fearful!

All I could think of was to get this person off my property, and Id better watch closely so they dont take the silverware.

Its not bad enough that this Mark Spain organization has wasted my time, and scared me, now Im getting spammed and I feel bullied with calls and emails pestering me to give them a 5-star rating.

Mark Spain is a big company, they probably dont care a hoot about what I say, but I hope my message helps one senior to be informed. They might be big, but I dont like the way they treat seniors!
