Took my $3300 retainer for a modification that I did not get and now may lose my home.

i retained Caplaw for $3300, I had lost my job and knew I would struggle making a $1400 house payment. I was behind one payment when I contacted them.

I went through the screening and they guaranteed that I would have a mortgage payment of less than $1000 per month. Several (over 10) different representatives called me weekly to say that they were handling all correspondance with the mortgage company and that i shouldn't talk to them that everything was fine. Now a new mortgage company took over my mortgage, they lowered my payment by $10/ month and I have to pay three payments immediately or I lose my home.

They ignore me and lie to me continually. I just want my retainer back or their promises honored.

Mortgage modification

They promised the world, took my money, and always had an excuse on why nothing has been done. No communication from anyone in the office and had five loan processors and none of the girls did anything.

Called the mortgage company myself after 18 months of the run around and made more progress in one month then the law office did period. I would NEVER recommend this law firm to anyone or any thing.

I gave them three thousand dollars to help my family out with a mortgage modification and they took the money and ran to the bank. CROOKS!

James Cioffi Law group -scammed me for 2500

Joe Prince of the Cioffi Law Group promised a loan modification for $2500. Said a refund of unable to do so.

I tried to get my money back 1 week after he got my funds out of my bank account, as I did not believe I would qualify for a loan mod., he got my money by deceit to begin with, then it was impossible to retrieve my money. They pretended to do a lot of work with my "loan", but when I called my lender six months later, they had not even received any paperwork from them. I wrote several letters to Mr. Cioffi, the owner, they were intercepted by Mr.

Prince, or ignored by Mr. Cioffi. They did nothing to try to get me a loan mod. & I'm sure they knew I did not qualify.

I have read reviews from others who also were scammed by this "law firm". They are heartless crooks and should be investigated in full and then shut down. There is nothing for me but the loss of my very hard to save $2500.

but hopefully someone will read this and avoid giving them any upfront money or using them at all. Please post this for all to see.

Promised to do a loan mod and did not, took my money and did nothing.

Was looking for loan mod for my mortgage, James Caplan called me and told me he would be able to do the loan mod.. that everything would be ok. Told me to start he needed a fee of $2,800 and start all the paper work. Followed his instructions till the end... got nothing...

Dealing with a Maria,,,l she kept trying to do is get some type of deal with my mortgage company.

Called mortgage company, found out she only called them 2 times... no results.. Told me to go to the hardest hit fund in my state.. currently working with., tried callingl James Caplan, informed that they have been out of the office over 3 months..

SCAM - i hired this company (James Caplan CAPLAW)to do a loan modification on 1/3/11 with 3 install

i hired this company (James Caplan CAPLAW)to do a loan modification on 1/10/11 with 3 installment payments of $2500.00, but two weeks later i found out this company is the same company as the law office of james cioffi which is known for scamming customers all on the internet. i should of got a red flag from the new bbb membership that they send you to prove they are BBB certified and they just changed the name to (CAPLAW P.A.).

2 weeks later I told the company i want to terminate there services and want my $2500.00 payment back and they said no refund. what i dont understand is why dont i get a refund back when they didnt do anything....Please dont use this company because you will not get a loan mod plus you will lose your $2500 retainer fee

Charged 3300usd got 1100usd for loan mod.

Talked to a Paul Mickelbrink, said the same things Kevin Upton told Frank. After they received 1100usd, still would not answer phone calls.

Second payment was to be made on the 19th of the month, they tried to get it on the 7th. Asked for an additional 75usd for insufficient funds. My bank told me this was illegal to charge that much. Closed bank account so they cannot use auto draft.

Would like to get refund, but not holding my breath. Contacted loan institution and am getting loan mod thru them.

Other names were Xavier(personal contact), Holly S.

(person working on loan mod), Clory N.(accountant), Kevin U. (salesman).

I think you should read the FTC Ruling called MARS. It defines what companies, inluding attorneys, can and can not do.

The laws have recently been updated in favor of the consumer. One thing that is very important to know concerning attorneys and any collection of moneys regarding home modification: Attorneys can collect money upfront, BUT, it must be held in an account and they cannot access it until the modification is complete and IF they have followed all of the laws regarding home modifications. The client CAN cancel. There is much more information in the MARS ruling that consumers need to be aware of.

Many times, you legally CAN get your money back.

Also, home modification are FREE if you go through the right channels. Call 1-800-HOPE-NOW and they will be able to help you.

Lied from beginning about how they help you

This is a scam. They ask you to pay up front a certain amount of money.

Then tell you - you will receive a package and you deal with your mortgage company yourself unless you want to increase that money to 3,300.. then they will do the work. This is not what I was told at first.

I made the first installment then was told I would get package and could deal with the mortgage company myself unless I wanted to pay the higher amount for them to do the work. They wont give you your money back if you decide you cant do this and then you are even farther behind in you mortgage payments and are now living with the fear that you are going to lose your home for sure.

Caplaw is a true scam. It would be nice to file a class action suit against these criminals.

They do nothing but claim to represent you and push paper.

For $0 you can do that yourself and work with the lender...instead, I paid $3,000 and had them NOT submit my paperwork on time. I learned my lesson, I only get screwed once.

I agree with Jeni. I have been looking online for a while now at the reports on this company.

Because I too was scammed by them. I looked at the FTC MARS rules. They broke a ton of them in getting my money which is the worst part. They are stealing people's money that need it the most.

There are all sorts of made up people bashing people and thier reports on this site. This post by "Winston" definately came from an employee.

I find it interesting that there are many posts (Winston being one of them)to all of the complaints against Caplaw, James Caplan and all of his multiple names and companies - all on the same day...And they are dissing the person filing the legitimate complaint. I do wonder if these are real people, the same person using different names, employees of Caplan...? Whether clients are happy with Caplaw / Caplan or not is really irrelevant because the bottom line is that they have broken laws.

Law Offices of James F. Caplan, P.A. are scammers

I have been out of work for three years even though I am willing and able to work.

I contacted these people to make our mortgage more affordable since we are a four person household living on one income.

They said they could work with us and get us a lower interest rate, even after seeing our paperwork.

They have taken $2000 from us and I am afraid they will get the last $1000 since it is on AUTOPAY!

If anyone knows how to stop this, a lawyer I can contact, or how to get my money back please post as soon as possible. Please

I was also scammed by this attorney's office. They took my $3000 and did absolutely nothing for me.

I decided to take matters in to my own hand and call the senator office. Thank God I took matters into my hand when I did.

I must say that with no help from the I finally got my modification. It is a shame how they pray on unsuspecting people.

My home was also sold after paying $3000.00 and was told that I more than qualified for a modification. They are not legit and after submitting every document that they requested, they want to say that they didn't receive all they paperwork.

Most government programs are free and I should have cancelled the payment. Do Not pay them any money, they will not follow thru. If she says her name is Heather hang up the phone with this foul company.

If a consumer was doing this much wrong to people, we would be prosecuted. Where is the Justice?

The firm is actually reputable and has helped me and one of my uncles get a decent loan modification. Maybe you need to speak with a supervisor / escalate your problem. I hope this helped.

I hired this company, for 3000.00 to protect me and advise, can conclude a modification agreement with my lender. For some , 12months plus, I finally got a agreement from my lender and now need their assitance to review and make sure I am not being taking advantage of.

I find that numbers have been disconnected, offices moved and finally I get a email from my representive to not contact him via phone, only email...I feel that now, once again our institutions allow people to prey on the weak and take advantage when these people are looking for help. What can we do?? How do we stop this?? I went to the Florida Bar Association and they had a good standing.

Now, I find reports online that they are SCAMMERS...

It is bad enough that I don't have the extra monies to waste and trying to obtain help....now only to find that I have less money due to spending with a scam firm and still no resolution. They must be stopped and we must all come together to press a group law suit against these scammers....

I am trying to get this lawyer disbarred. He does not stand by the Oath of the Bar Association and gives all lawyers a bad name which is not good for the Judicial System.

He is in GOOD STANDINGS now but was suspended for having non lawyers doing business when they were not qualified. If you go to “The Florida BAR “ and click on “Find a Lawyer” .... put in is name James A Cioffi” and you can read about the discipline report. He does have one strike against him but it still says”He is in good Standings”.

Actually I have his certification number and if you can’t find it-let me know.

He has many Alias’s and changes his name a lot. Also- moves from State to State

"Caplaw" is a scam...and "PREYS" on victums who have fallen on hard times and are trying to save their homes. We as well were one of their victims...and are now losing our home.

We cooperated with them 100%...were told not to talk to our mortgage company because it could jeopardize our loan modification with the mortgage company... that "they were working on"!!! Found out...when we received our foreclosure notice...that CAPLAW had done nothing and had had no correspondence with the mortgage company and had received nothing from them except the paperwork giving our permission for them to represent us. Upon attempting to contact Caplaw...we were told from our contact person that our file had been transferred to another consultant and they would be contacting us if they hadn't already.

We, as I am sure everyone who has posted here, are honest, hardworking individuals, who "TRUST" in others...and are seeking the assistance of what you were lead to believable was a reputable law firm!

Obviously he is not in jeopardy of losing his home....he is making his payments with his trusting victims monies!!! There has to be something that can be done to put a stop to this!!!!

I was solicited by a rep of James Cioffi, for a loan mod. I was emailed that it was a money back guarantee.

After paying $2500. up front, they basically made me submit the same docs that my bank had requested, several times...then, no response from them. my phone calls were not returned, emails ignored, etc. They took my money, did nothing, then, ignored me.

I'm pursuing them with another attorney, to get my money back. I think this should be a class action suit.

Crooks. Lying crooks.

i was solicited by james cioffi for a loan mod one of his rep who collected $2500.00

from me sending loan docs back and forth not communicating with the bank.

they are crooks . they keep saying over and over checks in the mail .

i have a contract and i am pursuing not only to get my money back and a whole lot more. since then i lost my home . they are responsible for this .i sent them money to do a loan mod when i could have sent to the bank. he has someone to answer the phone and tell you anything . its really a sad thing when someone is scam you out of your hard earn money and you try to do the right thing .

I can't accuse Caplaw of being a scam, but the Veterans Affairs offices, and mortgage lenders caution homeowners against "foreclosure rescue servicers" (such as what Caplaw purports itself to be).

There are non-profit organizations that are backed by the government that offer counseling and advice on loan modifications requests FREE of charge. You can go to www.makinghomeaffordable.gov, and speak to a counselor for FREE. They will give assess your financial situation, and tell you whether you qualify under one of the Fannie Mae, Freddie Mac, HAMP or VA-HAMP loan modification programs. The VA also provides this service for free if you have a VA loan (I was told differently on a couple of occasions when I called the VA, but found out the truth too late).

I spent 7 months working with the law offices of James Caplan trying to get my loan modified with Wells Fargo. Their services were sold to me at a time where I was desperate and I went for it. Seven months later, and almost $4,000 down the drain, they could not get my lender to come to an agreement. I did a LOT of the leg work getting all of the forms, letters and paperwork they needed to pass on to the lender...they're just middle men selling a service that's free, and unfortunately taking advantage of the uneducated, naive and desperate homeowners.

My loan modification request was denied after the 7-month ordeal, and now my home is set to foreclose in one week. I guess it's one of those lessons you learn the ugly way. When I signed up with Caplaw their words were "the only thing we can't guarantee is the rate of the modification loan". Sounds reasonable, right? Well they can't guarantee they'll get your loan modified either.

I wouldn't recommend them on the basis that if ANYONE tells you they can guarantee a modification, you should RUN.

That's what happened to me...but I didn't run, and now I'm up the proverbial creek trying to find a paddle in the next five days.

The Law office of James Caplan is a Scam

My husband hired this company in March to do a mortgage loan modification and they having been taking all sorts of information from us for months. We always struggle to get them to call us. Now they won't even respond to email. They told us not to pay our mortgage so they could negotiate with our lender. We have never been late in 20 years and now we are in foreclosure!!!

We are nearing retirement age and don't want to lose our home. This is a disaster for us. Please tell your friends. Call your lender yourself and work things out.

I had originally spoken with Kevin Upton, who said that I definately qualify, and he charge is $3000.00 I asked how long that was good for and he said "until modification is approved" I asked what if it wasn't he said "Thats not an option, we wouldn't take on your case if you didnt qualify" He also told me that they do not always accept the first deal a bank makes, they will send it back to be reworked and told me that they would get a principle reduction and my mortgage should be lowered between 800-**** month. I hired them, they did nothing that you can not do.

I had to send them paperwork that they sent to bank. My modification. I got a higher interest rate, the backed up "interest" added onto the end of an already upside down house and another 10 years tacked on to the term, and this only lowered it less than $200 a month.

Then the attorney called me he said "Banks are not doing principle reductions on home personal property, and this was best they can do" I feel that they are glorified telemarketers who will take your money and do nothing for you. BEWARE !!!

So let me get this right... You were modified by this firm, and the arrears were tacked to the back end of the loan and your mortgage was lowered about 200 dollars a month?

And your not satisfied?

and for the record the principle reduction is done only if you sue your lender, not modify. You seem like a real ***!
