this company will get their just rewards... see article

TALLAHASSEE -- Attorney General Bill McCollum today sued a Clearwater business, alleging it engaged in deceptive and unfair practices by charging for foreclosure

consulting services but failing to provide the assistance promised.

According to the lawsuit, Law & Associates, LLC claimed it could help homeowners who were facing foreclosure and charged an up-front cash fee of approximately $1,500

to $2,000.

Consumers reported to the Attorney Generals Office that the company not only failed to provide promised services but also refused to refund the fee despite an

advertised money-back guarantee.

More citizens in Florida are facing the very real possibility of losing their homes to foreclosure than anywhere else in the country, said Attorney General McCollum.

"My office will continue working to ensure that businesses who offer assistance to these people are held accountable to the law," said McCollum.

Law & Associates sends direct mailers to individual homeowners who are facing foreclosure. The mailers allegedly tell the homeowners they must call the company within

72 hours to see if they are eligible for a plan to stop the foreclosure process.

The company also advertises online, allegedly promising to stop the foreclosure process and providing a money-back guarantee if they do not achieve a viable strategy

with the lender to stop the foreclosure.

When homeowners contact Law & Associates, they are allegedly told they qualify for a plan to stop foreclosure but must pay the hefty cash fee for Law & Associates to

take their case.

Once a homeowner pays the fee, he or she purportedly receives a written contract from Law and Associates that contains numerous terms and conditions not previously

disclosed to the customer.

According to the lawsuit, most of those terms and conditions are designed to prevent a homeowner from being entitled to a refund if Law & Associates is not successful

in stopping the foreclosure. The Attorney Generals office has received more than 65 complaints from consumers about Law & Associates.

The Attorney Generals lawsuit alleges six counts against Law & Associates and Thomas E. Law, II for violations of Floridas Deceptive and Unfair Trade Practices Act.

The Attorney General is seeking penalties of $10,000 per violation and reimbursements for consumers who paid the fees.

The lawsuit also asks the Court to require the company to cease its operations.

I contacted this company in July 2007. They were suppose to help save my home. They requested a fee of $1980.00 and they guaranteed they would work something out with

my mortgage company to avoid foreclosure. My mother made a deal with the mortgage company and called law and associates requesting a refund. They told her to send an

e-mail to jason nadler, requesting the refund. That was August 7, 2007. We have been calling and e-mailing mr nadler since then. We still have not received the refund.

I was going to use the refund to honor the deal my mother got with the mortgage company, since there was no refund, there was no deal. My house is scheduled to be sold

in the very near future. I have contacted the BBB, Florida States Bar Association and the states attorney, still no refund. What ever you do, don't deal with this

company.

Re: Law & Associates and others like you

AUTHOR: Terri - Benton (U.S.A.)

SUBMITTED: Tuesday, January 02, 2007

Again, I will reiterate that Law and Associates are truely out there to rip people off. I am Terri and yes, I lost over a thousand dollars to these people, they like

to come back with rebuttals and state that I was not honest, which I was. They knew my story, they knew my problems, apparantly I'm not the only one they "ripped off".

My only comment now is to anyone considering assistance, not only from "Law and Associates", but anyone else who "claims" they can help you with your foreclosure

problems, they cannot do anything that you cannot do for yourselves.

All you have to do if your having financial trouble is to contact your mortgage company and try to work out a plan. If you are too far behind, then, your better off

trying to sell your place before the foreclosure date. My point is that these companies can NOT do anything more than you can simply do by trying to negotiate

yourself. That's all they do, but they charge you a couple of thousand dollars to do it. Go back at look at your contract, it will state everything.

Also, go to your local library and read up on your rights as a homeowner in trouble of losing your home to foreclosure and your rights. Or, research online, but stay

away from these companies that offer help, if it sounds too good to be true it is.. And legally they can do no more than you can as far as negogiating with the bank or

mortgage company. So save your money. Stay away from the crooks, or you'll be like the rest of us, trying to fight for the huge amount of money we spent listening to

people who think that the huge amount of money we gave them is such a small amount to them to pay for the same thing we can do ourselves.

It does not surprise me that employees constantly respond back and state they do not know who I am. If anyone is interested in reading the many emails, including the

one I sent in explaining my situation to them.. I'd be glad to show anyone, and I'd be glad to show anyone all of the copies of our "paperwork" that we had to

complete. I kept everything! Including the so called "Money Back Guarantee" they sent with the documents. I still have the entire file they sent me. Yet, they "do not

know me".

I'm done with this, I've never seen a company try so hard to "cover their tracks" If I have never been heard of by Law and Associates, how would I know of Randi Rivers

who works for you? Shall I plug in more names of people that I spoke with while paying for a bogus service.

I mean come on, I even had the mortgage company tell me I should not have wasted my money after we ended up settleing things with them. If this company is so honest

and trustworthy then why worry about your "reputation" so much with the constant rebuttals?

My only goal here is to inform people of doing extensive research, contacting your mortgage companies directly and reading your contracts in detail before spending any

money on the "service" these companies suggest they provide.

Law And Associates ripoff fraudulent in warrenty statements and services Clearwater

Contacted Law and Associates to inquire whether or not they may be of service to help us avoid foreclosure on our home. Stated to them that we had tried to do a work

out with the bank "lender" and that we could not make the 24 hour deadline they were requireing, also informed that that we were in a bankruptcy and would they still

be able to assist us with our sitation. "of course, they can help us" Ms. Randi Rivers stated. She asssured me that the bank "had to work with us, because we work with

government programs to do work out programs for you as long as you can provide us with efficient income and a statement assuring that you are out of the hardship that

brought you to the current situation".

We provided all of this information and I again asked her before submitting the $795 payment, are you sure this will work with our situation, because I just do not

have that kind of money lying around, that if i did, I think i would not be in this situation to begin with. She assured me that "if they could not provide us with a

workable situation with our lender, that we would be able to have our money refunded, based on thier money back guarantee".

After submitting all additional paperwork, they tell me there is nothing that can be done, they could not get the bank to do a work out. And, now that I've tried to

excercise my rights to their "money back guarantee", they are saying that I did not disclose infomration to them and therefore am not eligible for a refund. Basically,

now that I've been talking with attorney's, they did nothing more than I could have actually done myself, that every homeowner has the right to do without the

assistance of attorneys such as Law and Associates or anyone else, but again, every homeowner has the right to speak with their lenders mitigation department to try to

do a work out and here I was the *** to seek help and be assured that they could help me as was ripped off for $1,590. Beware of companies like these, they flat out

lied to the attorney generals office when I filed a complaint and stated that I was not truthful with them.

On May 1,2006 I contacted them to see if they could help me save my home. I spoke to Dan S. He told me that the company would work on my behalf with my lender. He also

said that Law & Assoc. were a member of the BBB. I was told that we could make payments over the next few weeks so I asked over & over if they would be able to help

me. He assured me that I would not lose my home. So I sent a payment of 250.00.

On May 2,2006 I faxed all the paper work they requested. the next 3 weeks I kept in contact with them about anything I had recieved or calls from my lender.

Around the 3rd week I sent them another payment of 600.00 and that is when I was told that they will not do anything on my behalf until they were paid in full.

The sale date came and went.On June 17th I sent them a letter stating that I am requesting a refund of the 850.00 I paid them for the reasons of giving me misleading

information, such as being a member of the BBB,which they are not. For not contacting my lender. They have done nothing worth 850.00 and that I would not be sending

anymore monies at this time. I requested that the refund be mailed within 2 wks of recieving the letter.

On June 27th I called and spoke to Mr.Boyle.The company had recieved my letter & it went to the commitee on the 23rd of June & something should be decided in a few

days.

I have called several times with no call backs from them.I have also emailed them too with no response.

This company did not do anything for the amount of 850.00.They Never contacted my lender! I emailed them to send me proof of the services they have provided & they

have until July 12th(reg mail) or July 7th by email. If the can show me proof of the work they did on my behalf then I am willing to take a reduced refund of 600.00

but no less.I have contacted the BBB. The next step is to contact the attorney general in FL.I will fight this until I get what I am deserved. I did the leg work &

everything else I paid them to do!

On the bright side, My home was not sold & I found a non-profit organization who helped me for free! I & my husband NEVER expected to be in the situation of maybe

losing our home & when I contacted Law & Associates I really put my trust & faith in them to come up with a plan to save my home which they DID NOT do.

Some advice...If your are in the situation of losing your home. First of all DO NOT pay anyone to work on your behalf with the lender. You contact your lender

immediately & keep in contact with them.Find a local non profit housing organization to see if they can help you. Please do not give this company or any others your

money that you do not have in the first place.they know how to reel you in & take your money for services they promise to providethen never do.

First of all,why have I yet to receive the info I asked for in July of 2006? You have had ample time to send it.If your company did nothing wrong then you shouldn't

have a problem with sending me the info I requested ASAP.

Your company NEVER contacted my lender. My husband NEVER negotiated any plans directly with our lender.A non profit organization helped us.Now the reason for no refund

is because we lied to you about several plans we had with our lender? Since when did the reason for no refund change?

About the BBB...I know you are not a member but that's not what Dan S. told me. I was told by him that your company was a member more than once. You don't call that

misleading? They tried to contact you several times about my complaint but you never responded. If you did no wrong wouldn't you want to tell them that?

I don't take being lied to lightly. I did the leg work I paid you to do.I requested simple proof of the work your company did for the amount that I paid you.

Come on for once be a stand up guy and show people that I'm wrong about you and your company.

I would love to see it happen.

Thomas E. Law, II., so it appears this guy is not an attorney...

Thomas E. Law, II., so it appears this guy is not an attorney, yet is trying to capitalize on his last name and give the appearance of having the ability to do what he states.was sending out direct mail solicitations to Floridians who were going through the foreclosure process. The company offered foreclosure consulting services, but charged a large up front fee for those services, never followed through on the services, and failed to return monies despite a money back guarantee.

As the whole world knows, Lee County, Florida is leading the nation in foreclosures. The cities in Lee County that are experiencing the highest foreclosure rate are Cape Coral and Lehigh Acres. According to the latest statistics, something like 1 in 86 homes in Lee County are in the foreclosure process, and not much is being done to fix the leak in the dam.

Of course, with every crisis, there will be scam artists who will try to make money from the less fortunate, and there will be those that try to stop the scam artists. The Florida Attorney General, Bill McCollum, recently filed a lawsuit against a business in Clearwater, Florida for the use of unfair and deceptive practices against the public. The company named Law & Associates, LLC was sending out direct mail solicitations to Floridians who were going through the foreclosure process. The company offered foreclosure consulting services, but charged a large up front fee for those services, never followed through on the services, and failed to return monies despite a money back guarantee.

This scam involves the company monitoring the public records for foreclosure filings. Once they obtain the names and addresses of the individuals being foreclosed upon, Law & Associates, LLC immediately starts a direct mail campaign aimed at getting the homeowner to pay the consulting fee. (Interestingly, a search of the Florida Bar's website reveals that that there is no known member of the Florida Bar listed as Thomas E. Law, II., so it appears this guy is not an attorney, yet is trying to capitalize on his last name and give the appearance of having the ability to do what he states).

Either way, the distressed homeowner is told that they have 72 hours to contact the company and when they do contact the company, they are told that they are eligible for the program, but they have to come up with a consulting fee of $1,500 to $2,000 for the company to take their case.

If the distressed homeowners can come up with the funds, then they must sign a contract which pretty much waives the consumer's rights to have their money back. To realize the impact of this strategy, you have to realize the vulnerability of the distressed homeowners. These are good people who are desperate to save their homes, and they have probably been around the block several times with their lenders trying to get the mortgage modified or had their payments sent back to them for one reason or another, and they just want some relief.

Law and Associates latest fraud:www.housingrecovery.org.

Tom Law is a dishonest businessman and constantly scams consumers and the general public. It may seem like a bold statement, but if you Google him and his company "LAW AND ASSOCIATES" he has a long list of complaints in many different shady business dealings. The attorney General of Florida is aware of him along with the BBB. What amazes me is how TOM LAW from LAW AND ASSOCIATES has not been stopped as of yet.

I know him first hand. My wife and I were social with him and his wife, Mary Anne and knew his three daughters: Dianna, Shantel, and Elise. I stopped associating with him three years ago when he refused to pay me a large commission on a business deal in Florida. He somehow managed to take advantage of me and my partner through his multiple corporations, bullying and his team of dishonest lawyers. He is very smart, cunning and knows how to use loop holes in the law when trying to take advantage of clients, customers and business partners. For those deciding to do business with LAW AND ASSOCIATES, I would strongly recommend caution.

What amazes me is how he can flaunt his rich lifestyle and brag about his trips, famous friends and his large exotic car collection while stealing from the public. On the surface, he looks and acts like a legitimate and successful businessman. But after awhile, his facade fades and the real con artist emerges that has no remorse towards those he hurts financially and emotionally. TOM LAW'S ultimate goal is to get rich and he doesn't care whom he steps on as long as he can continue to fund LAW AND ASSOCIATES and his seven figure income.

Recently, a member of our church mentioned that her daughter received information from WWW.HOUSINGRECOVERY.ORG and unfortunately fell for his latest scam. She spoke to Scott aka. "NICK" and was mislead, misinformed, lost monies and damaged her credit further by entrusting her desperate situation into the hands of Tom Law from LAW AND ASSOCIATES. I know that Tom Law is involved since I personally know two of his ex employees who were recently let go and decided to share some sensitive information about his internal organization of WWW.HOUSINGRECOVERY.ORG .They felt uneasy working for a United States company committing fraud and when they spoke up, LAW AND ASSOCIATES decided to fire them. I couldn't stand still any longer and decided to share this information with the general public before more innocent people got hurt.

If you receive a mailing from WWW.HOUSINGRECOVERY.ORG, please do not fall in the trap set by LAW AND ASSOCIATES. Tom Law knowingly uses government icons, logos and warning messages that are neither accurate nor approved and is intended to scare potential customers into signing up with WWW.HOUSINGRECOVERY.ORG.

If you are still unsure and are questioning my message, please take the time and call your local government representative to verify if you are on a "last and final warning list", have been singled out by the government, do indeed have the problems being stated on the mailing, or just do your own research to confirm that what I am saying is true. If you still are convinced that TOM LAW from LAW AND ASSOCIATES is trustworthy, then by all means, send him your money and take your chance. This is their contact information:

Massachusetts Halts False Foreclosure "Rescue" Activity

Firm claimed to be "non-profit"

June 22, 2009

One by one, the state of Massachusetts is targeting firms that claim they can

"rescue" distressed homeowners from impending foreclosure. The Massachusetts Attorney

Generals office has obtained a preliminary injunction against defendants H.O.P.E.

Alliance, Inc., (H.O.P.E. Alliance), Law & Associates, LLC and Thomas E. Law, II.

The preliminary injunction prohibits the defendants from publishing advertisements

concerning foreclosure-related services, contacting Massachusetts consumers regarding

foreclosures or mortgages, and taking and/or soliciting advance fees from consumers.

The preliminary injunction follows a temporary restraining order granted against the

defendants in early June.

In a complaint centers on the all-too-common practice of soliciting unlawful advance

fees for foreclosure-related services, and unnecessarily delayed negotiations

regarding loan modifications. The two together, says Massachusetts Attorney General

Martha Coakley, usually pushes homeowners further into debt.

The complaint also alleges that H.O.P.E. Alliance, with the help of co-defendants Law

& Associates, LLC, and Thomas E. Law, II, solicited homeowners facing foreclosure by

sending letters that directed them to a toll-free number and to the website

www.helpnowalliance.org.

The website states that it is an alliance of nonprofit organizations and housing

counselors that can assist homeowners in obtaining a loan modification or stopping

foreclosure. The website also states that it is a 501 (c) (3) non-profit

organization.

"H.O.P.E. Alliance is not registered with the IRS or the Attorney General's Office as

a non-profit," Coakley said. The Attorney General's complaint also asserts that in

its letter to homeowners, H.O.P.E. Alliance deceptively used a similar name to the

government-sponsored non-profit organization, HOPE NOW Alliance.

During telephone calls with consumers, defendants apparently attempted to skirt the

law by asking for a "donation" instead of a fee, but Coakley says the request is

still an unlawful fee. Defendants also allegedly promised to obtain loan

modifications for consumers, and then after months of delay either failed to provide

any services or only provided inadequate assistance to homeowners.

LAW AND ASSOCIATES LLC CLEARWATER FLORIDA

Madigan Alleges Florida Company Takes Advantage of Homeowners

on the *** of Losing their Homes to Foreclosure

Chicago – Illinois Attorney General Lisa Madigan today continued her aggressive legal

fight against mortgage fraud by filing a lawsuit against a Clearwater, Fla., company

which operates a rescue fraud scheme that preys on vulnerable homeowners on the ***

of foreclosure. This is the 14th lawsuit Attorney General Madigan has brought against

mortgage rescue fraud companies.

Madigan filed suit in Cook County against Law & Associates LLC, and its managing

member, Thomas E. Law, II, alleging the defendants violated the Mortgage Rescue Fraud

Act and the Consumer Fraud and Deceptive Business Practices Act by falsely promising

to help consumers save their homes after falling behind on their mortgage payments.

According to the complaint, the defendants charged consumers up to $1,900 and

promised to provide mortgage foreclosure rescue services that they either failed to

perform the services or only performed ineffective services. Attorney General

Madigan’s Consumer Fraud Bureau has directly received one complaint relating to the

defendant and 68 complaints referred from the Better Business Bureau.

“In the midst of the mortgage foreclosure crisis, unscrupulous people are using so-

called mortgage rescue scams to prey on vulnerable homeowners,” Attorney General

Madigan said. “I am continuing to take aggressive action against these illegal

schemes to send the message that their deceptive and fraudulent practices are not

welcome in Illinois.”

Madigan’s lawsuit alleges Law & Associates market mortgage rescue services to at-risk

homeowners, encouraging them to call a toll-free number where they are told there is

an upfront fee of $1,990 for mortgage rescue services. Consumers who indicate they

cannot afford the charge are offered a reduced rate of $1,800 on a payment plan that

must be paid in full prior to them receiving any mortgage rescue services. The

defendants also promise desperate homeowners that the service fee is refundable if

the company is not able to successfully negotiate an agreement with the homeowners’

mortgage lenders or provide a “viable strategy” to avoid foreclosure. The lawsuit

alleges the defendants fail to provide the services promised and fail to refund the

service fee.

Madigan’s suit asks the court to prohibit the defendants from engaging in mortgage

rescue practices. The suit also seeks a civil penalty of $50,000, additional

penalties of $50,000 for every violation found to have been committed with the intent

to defraud, and a $10,000 penalty for each violation committed against a person 65

years or older. Further, the suit asks the court to rescind the contracts signed as a

result of these deceptive practices and offer full restitution to affected consumers.

Finally, Madigan’s suit asks the court to order the defendants to pay all costs

associated with the investigation and prosecution of the lawsuit.

The lawsuit is part of Madigan’s ongoing work to curtail the foreclosure crisis and

help Illinois families stay in their homes. Madigan’s office has sued 14 mortgage

rescue companies to stop deceptive practices and successfully participated in three

multi-state settlements against major subprime lenders: Household Finance, Ameriquest

and First Alliance Mortgage Company. To date, Madigan’s office has obtained nearly

$900 million in enforcement actions against these lenders.

Last year, Madigan announced a comprehensive strategy to address the looming home

foreclosure crisis in Illinois. As part of this effort, Madigan’s office hosted a

statewide home ownership preservation summit in July 2007, bringing together more

than 100 participants from the mortgage lending industry, consumer advocacy groups

and government agencies to identify problems and look for solutions to mortgage

foreclosures.

On the legislative front, Madigan worked to pass the High Risk Home Loan Act of 2003,

and drafted the Mortgage Rescue Fraud Act of 2006, which was designed to deter scam

artists from preying on vulnerable homeowners on the *** of foreclosure. The

Attorney General also initiated and drafted the Illinois Homeownership Protection

Act, a new law that tightens controls on brokers and lenders to prevent consumers

from being unwittingly locked into questionable loan terms.

Madigan also has sued mortgage giant Countrywide Home Loans, Inc., for deceptive and

fraudulent loan origination practices. Additionally, she has issued fair lending

subpoenas to Countrywide and Wells Fargo Financial Illinois, Inc., to determine

whether these companies steered African American and Latino borrowers into higher

cost or otherwise inappropriate home loans in violation of fair lending and civil

rights laws.

Madigan urged Illinois homeowners who are facing foreclosure to immediately contact

their mortgage company or a HUD-certified housing counselor for assistance. To get a

referral to a certified housing counselor or to learn more about the steps to take to

avoid foreclosure, homeowners can call Madigan’s Homeowners’ Referral Helpline at

1-86*-***-**** from 8 a.m. to 5 p.m. Monday through Friday.

Homeowners also can visit Attorney General Madigan’s Web site at

www.IllinoisAttorneyGeneral.gov, to access the Illinois Mortgage Lending Guide, a

resource manual containing step-by-step instructions for those struggling to make

their loan payments and a list of HUD-certified counseling agencies that offer

default counseling services. Homeowners who do not have easy access to the Internet

should call the Attorney General’s Referral Helpline to request a copy of the guide

by mail.

Assistant Attorney General Kevin Rouse is handling the case for Madigan’s Consumer

Fraud Bureau.

This message is to Law and Associates. You want facts.

I have emails that thankfully I have saved from your company. You took my money saying that you would help us out of a foreclosure and then after we paid the money was told that you could not help. Oh and of course, you did not respond to request for money return. On top of it all, you referred me to someone else who could help out "National Homeowners Financial" (foreclosure rescue scam).

Which scammed us out of more money and your employeed (who referred us) got a 1500.00 kick back from National Homeowners Financial. How convienent. Needless to say, we lost our home because of all this and National Homeowner Financial is out of business.

So if you want to talk facts, feel free to email me at smcglynn123@***.net. And believe you me, I am not done yet!

This company is a fraud! On April 1, 2008 they contacted me and portrayed themselves as being affiliated with my mortgage company.

Law and Associates explained to me that I was in foreclosure and for a payment of $1590.00 my account would be brought to a current status. I was supposed to receive a contract to review and sign. The money was taken out of my account 14 hours after my conversation without seeing the contract. After calling my bank, I discovered Law and Associates was a fraud and a scam!!!

I immediately demanded my money back. I was told I would receive a full refund within 60 days. Since then I have repeatedly tried to contact Tom (the owner) and Jason Nadler. Both of which were rude and refused to return my calls, email, faxes or letters.

I would beware of these cruel people praying on people in bad situations!!!!

I want Law and Associates to know.... you won't get away with this!!!!!

Now to address Jesus and Gloria,

It seems that those year old complaints were posted at the same time as William B. hmmmmm, you could have at least edited them to make them look like new ones.

So I guess that means I get to post one too.

I would like to deeply express my heart felt gratitude for what you have done for my life. I was on the brink of losing my home, I was behind three months of payments, and my communication with Ocwen (my lender) wasn't going so good. I took a chance one day and called a number I found on the internet and somehow I was connected with your firm. I could not make another mortgage payment anyways so I prayed to God and left it in his hands, and yours. You sent me John, I can't remember his lat name, it starts with a S, like shumaker, or something like that, I am not good with last names. Anyways, he said he will be realistic and see what he could do for me. He worked his negotiation skills beyond belief, the deal he got them to give me was remarkable! God answered my prayers and my life has been given to me again. He got them to reduce my first loan from payment of $2,300.00 to just over $1,800.00 and from an adjustable rate to a 6% fixed rate, and they reduced the second loan from $63,000.00 to $3,300.00 (that was amazing in itself) and made my payments on that loan from $575.00 to $25.00, I still can't beleive that. And all I needed to do was make a payment of about $5,600.00 I could not thank him enough over the phone for what he did for me I wish I could remember his last name but it escapes me, but I wanted to tell this firm that whatever you are paying this man, It isn't enough! I am telling as many people that are in jeopardy of losing thier home as I was, and now I can sleep at night once again. I usually don't write letters to thank anyone for any reason but in this case I must say, Thank you for saving my life, I would not known what I would have done if the foreclosure letter would have finally come in the mail as I was expecting it to. And now it never will. God Bless all that works with this firm, and keep doing Gods work by helping families stay in thier homes.

A very Thankful Client,

Keneith

Anyone having any complaints regarding the business dealings of Law & Associates LLC, Clearwater, Fl. regarding their business practices as a mortgage foreclosure company, offering assistance for a fee, refusing to refund a fee for services not rendered, or a program where they offered to purchase a home in foreclosure is encouraged to contact the Florida Attorney General's office at the phone number 813-287-****.

Will, It seems you wrote the same complaint to another company prior to posting this one. This complaint seems to be copied from another site. We don't have a 1995 dollar fee or a "RUSH" service so please get the facts strait before posting bogus information.

I have attempted to locate your file to see if I could address the problem you may have had. However, there is a very limited amount of information to go on so feel free to contact us and I will review your file.
