Hello. Recently my spouse, Benjamin Burnett was terminated for a failed drug screen.
Well actually it was deemed tampered with, we're not sure what that means. A DOT drug screen can not be disputed and no retest. Hes been a truck driver for 13 years. No failed drug test.
No motor vehicle accidents, hasnt had a traffic ticket in years, clean MVR & no criminal background. He has applied for several NON driving NON safety sensitive positions in the last few weeks. He inquired as to why a particular company did not hire him and was told his former employer Koch trucking company is telling potential employers that he was fired for a failed drug screen even though he is not applying for a safety sensitive driving position. I believe that's a violation of the HIPPA privacy act.
Why tell that to potential employers? Stan Koch and sons are impeding his ability to find employment. It's called blacklisting.
After he was told what Koch was saying about his termination I called the HR department over drivers in Minnesota and pretended to be a potential employer and spoke with Kela.
She didn't ask what company I was with or the position he was being considered for and was happy it seemed to tell me why he was fired. This could potentially lead to lawsuits against Koch.
