I booked a cruise with Kimberley Quest, located in Broome, Australia; a small ship adventure cruise. A $5000 non refundable deposit was required one year in advance.

Due to a foreign travel ban, I was denied entry into Australia on 3/15/2020 and the cruise was cancelled shortly before its sail date of 3/31/2020.

The initial harsh response from Kimberley Quest was to charge the 100% cancellation fee through no fault of my own. For 10 weeks, I have begged and pleaded for a refund. Kimberley Quest has been instructed by the ACCC (Australian Competition and Consumer Commission) to offer its customers a refund or a voucher. It has chosen only a voucher and hold hundreds of thousands of dollars hostage.

The Western Australia Department of Mines, Regulation and Safety advocated on my behalf repeatedly with a weak response again, a voucher.

My option is now to go to Magistrates Court.

This situation has been a long and stressful process. During these 10 weeks, I have been a first responder in the corona virus pandemic as an anesthesiologist; placed in dangerous situations daily. Additionally, I am a cancer survivor.

I have notified Kimberley Quest ad nauseam , that I am unable to travel to Australia for many years.

PLEASE, please buyer beware with Kimberley Quest cruises. As a foreign national, I have little recourse for a refund.

This company is unprofessional, unethical holding hundreds of thousands of dollars, and not offering foreign customers a refund.

In effect, they are committing robbery. It is in excess of $20,000 US.
