Gostar Sport is in Breach of Contract & won't compensate or refund money

If you are considering doing business with Gostar Sport, located in China ( that I was introduced to and found on, PLEASE DO YOURSELF A FAVOUR AND READ THIS FIRST. You'll thank me later. Over the past 8 months, I have been working with Gostar Sport on creating custom golf gloves. Gostar was very engaging for the first samples. I then ordered 30 test gloves and I received 30 gloves that were completely unusable, some were deformed, but mostly the sizing was not as we agreed, the thumb on most of them was 1 1/2 x longer than it should be! Gostar remade the 30 samples, however they still changed me a reduced fee and I had to pay for the shipping of the second attempt of gloves. I did finally receive the test gloves and most met the specifications we had agreed to. On Oct 17, 2017, I entered into a contractual agreement with Gostar. The contractual agreement was for payment of bulk production of 1000 custom golf gloves and custom envelopes. The agreement stated that if payment (a 50% deposit) was received by October 18, 2017, Gostar agreed to have the gloves ready for shipment by December 8, 2017. I paid $2525 USD on October 18, 2017 by bank transfer. The remaining balance was to be paid upon shipment. At my insistence, we detailed all of our agreements for sizing, materials, quanities, shipping date, etc. on the invoice. I also prepared an agreement in principal that spelled out all areas of the agreement and measurements and discrepancy allowances etc on October 17, 2017, prior to sending deposit payment. Also agreed to within this arrangement was for Gostar to provide regular updates and Quality Assurance (QA) checks. Without receiving any updates or QA checks after payment, I inquired about the status on November 10, 2017. I was then told by Gostar that the gloves were not yet started, but not to worry and to trust them, my gloves could possibly be rushed to meet the Dec 8th deadline. I was then told by Gostar that the order hadn’t been started because Gostar staff was afraid to start order because they couldn’t produce high quality gloves. I then asked for a refund because our contract had been breached and it was apparent that they weren't interested in manufacturing quality gloves. That request was denied, or more like ignored. Gostar then advised me that the deadline was impossible because Gostar had moved their factory and had shut down….obviously this was a spontaneous move and outside the responsibility of Gostar!!! Again, I asked for a refund because our contract had been breached. Again Gostar denied it faining hey….they were estimated dates, what’s the problem….trust me, pay me more…no problem lady….just give us more time and money without any accountability whatsoever!!! I put my foot down and made it 100% clear that Gostar was getting NO more of my money, I had no intention of paying any more money once our contract had been breached and I’d been told numerous blatent LIES! After repeated requests for refunds, Gostar agreed to make a reduced amount of gloves (430 as opposed to 1000), plus the 1000 envelopes for the amount of money I’d already paid over 2 months ago at that time. At that time that we renegotiated, I thought was in good faith (silly me), I asked Gostar (Emerson) what date he could commit to have my revised & reduced order ready for shipment by and revised the invoice accordingly. Gostar stated they could commit to havin the revised order of gloves ready for shipment by January 10, 2018. On January 8, 2018, I began inquiring about shipment date that was 2 days away, and was told they would be ready within the week. I followed up again on January 14, 2018 and was told by Gostar that they might be ready maybe in February. Our contractual agreement has now been breached 3 times and no acceptable commitment has been made, nor compensation for the breaches. In addition to me now being out $2525 USD, this is beyond the worst customer service experience I’ve ever heard of. Gostar has absolutely zero accountability for their breaching of contracts, nor any moral obligation. Furthermore, the male representative has always spoken to me dismissively and condescendingly. It should also be noted that Gostar accepted payment by paypal when I was working with and paying for samples & test gloves. However, they refused to accept paypal or credit card for the bulk order, so I now have no recourse to request a refund. Well planned out from their standpoint.
