Bait and Switch Attempt by a Retail Seller

Buyer purchased a fabricated glass table top from Seller(Daniel Peretz at Gallery 23, Inc.)Buyer provided Seller with a complete Table Top sample for exact measurements. Seller called his basic glass supplier for a materials price quote. Buyer and Seller then reached agreement on price/delivery and executed a written Purchase Agreement. Three days later the Seller(Peretz)called the Buyer and demanded that the original price be doubled! Buyer refused since no changes in the Table Top specifications had been requested. Seller then initiated a series of high pressure, harassing sales actions against the Buyer. Buyer continued to decline the doubling of the contract price and insisted that Seller honor the original purchase contract. Seller then attempted to void the original contract by making unacceptable changes in the product specifications. Buyer refused these unworkable changes and Seller then simply declared in writing that he refused to complete the contract. Buyer then had to file a formal complaint with the New York City Department of Consumer Affairs(NYCDCA).The NYCDCA investigated and after three months was able to obtain a refund of the Buyer's original deposit. The NYCDCA did not prosecute the Seller due to the relatively small amount of money involved. Buyer had to devote considerable resources during many months to trying to convince the Seller to honor his original commitment, rebut false statements made by the Seller to government investigators, correct errors and misrepresentation of facts by the Seller, and in challenging insulting personal attacks on the Buyer by the Seller.
