. I had notified the Community Manager that I will not renew my lease for the fourth year, and served her a 60-days notice-yo-move-out.

Then, on Friday 02/3/2023, my rent payment from my checking account failed payment.

The next day, Saturday Feb 4, while I was at my Wells Fargo bank to ascertain why the payment failed, they assistant manager served me a Notice-to-Vacate with 10% late fee increased. I paid it fully with funds from my Savings account. But the management still proceed to filing an Eviction Case with Dallas County so that they will frustrate and jeopardize my February 28,2023 move out date with Eviction suit on my Rental history.

today Tuesday February 14, 2023 at 11:50 am CST, I was served a court citation for eviction by Dallas County Constable inspite of my having paid in full my February 2023 rent my last rent and served the required 60 days notice-to-move out at the end of my current third lease which expires on February 19, 2023.

Here is a chronological sequence of events.

02/08/2020. I signed a 12-months lease and moved into Winsted Apartments managed by Gains Investment Trust.

12/16/2021: I renewed my lease with another 12-month lease terms from 02/08/2021 to 02/08/2022.

02/19/2022: I signed another lease renewal from 02/19/22 to 02/19/2023.

11/22/2022: I received a correspondence from the Community Manager at Winsted Apartments, Ms Elizabeth Nessenthaler asking me to renew my lease again for the fourth time.

I declined because of threatening cracks on the living room area, guest balcony, and master bedroom balcony. A visual inspection of these cracks will show serious foundational issues, and all my attempts to get the management team to look at was futile.

12/28/2022: After a lengthy and pensive introspection, I decided to tender my 60-days Notice to Vacate to the Community Manager despite their invitation for me to renew.

01/03/2023: Because my current lease expires on 02/19/2023, Brenda Martinez, the assistant manager/bookkeeper wrote me stating that I would have to pay my February 2023 rent on a month-by-month (MTM) basis.

01/13/2023: I responded to Brenda Martinez correspondence dated 01/03/23, noting the simple fact I understand the Winsted Apartments is not a happy camper whenever there is a resident leaving, but I advised her that we should not sever our long-term relationship with bad blood. I pointed out sections on my current lease which stated that my last rent will be prorated because it expires on 02/19 and the remaining 9-days on the February month should be prorated on MTM + MYM fees, and I will pay it immediately.

01/19/2023: Ms Brenda Martinez replied me that my upcoming rent will not be ready until 01/27/2023.

02/03/2023: I paid for my final February 2023 rent of $2, 023.46 at 5:30pm CST. I immediately received automated FAILED RENT PAYMENT messages from Gains Investment Trust system.

I documented it.

02/04/2023: I received a NOTICE To VACATE letter posted on my front door on Saturday morning February 4, 2023, while I raced to my Wells Fargo bank to ascertain why my rent payment via my Debt Card was declined. The Notice To Vacate had an increased 10% late fees added totaling $2,215.19 (from $2,023.46 original rent).

02/07/2023. I revisited Wells Fargo bank and I was informed my direct deposit paycheck was placed on HOLD until Thursday February 9, 2023.

TUESDAY 02/072023: I made another Rent Payment of $2,216.14 for my February 2023 Rent. See attachment.

TUESDAY 02/14/2023: I received a Dallas County Citation for Court litigation stating failure to pay rent, and immediately repossession and evictions of all occupants at unit 2030 located at 10515 N MacArthur Blvd, Irving Texas.

Without any cloud of doubt, it is clear that Gains Investment Trust management team at Winsted Apartments is focused on having an EVICTION SUIT on my rental history and frustrating my moving out of their property without any reason whatsoever.

I have until 02/28/2023 to peacefully move out as planned and have paid my Rent in full plus all fees. But in other to frustrate and distress my Rental history someone in the Winsted Community decided to proceed with filing an EVICTION CASE on Wednesday February 8, 2023.

I am categorical stating that as at February 8, 2023, I had paid my February 2023 rent to Gains Investment Trust from my Savings Account number ending in 8434 on the propertys portal. In addition, let me apprise Gains Investment Trust that I will not shy away from fighting any false statements made by your management to tarnish my Rental history with your organization.

It is appalling that the Winsted Apartments Management have chosen to adopt a Machiavellian ploy to destroy my three years rental relationship because someone is having a fit of bad blood and hell-bent to stopping me from exercising my civic rights. Instead of doing the right thing, by inspecting and repairing the foundational problems in the living areas of your tenants residence, you prefer to bully me to stay in a unit 2030 with visible and threatening cracks.

I am not interested in filling any accident claims or ruining my life from an accident waiting to happen.

Thus, I have made up my mind to move-out from this unit 2030.

Allison, I pray and appeal to you to send someone here to this unit, you will see the deplorable state of the foundational cracks.

I shared videos I made of this apartment with Page in the leasing office on February 1, 2023. I believed she communicated that to Elizabeth Nessenthaler, but the management team is more committed to forcing a black man to live in an accident prone apartment unit instead of repairing; maybe because black lives does not matter.

Preferred solution: Retrain from making any FALSE EVICTION on my rental history since I do not owe any debt to Gaines Investment Trust/ Winsted Apartments. I need their facilitation of my upcoming February 28, 2023 move-out with honest rental history reference. Thank you.

Rip off

I began renting an appartment at one of their Las Vegas properties. The apartment has had at least one issue after another.

In fact, the light and dishwasher still do not work properly, and the rules are selective. I just had four residents tell me my car will be towed for backing in. I have NEVER been late with my rent. I want out of this lease!

Nothing in the lease says anything about backing in. Of course since I cannot access my mail most of the time I wouldn't know if I got a notice which by law should give me 30 days notice for lease changes.

All of my windows leak and it's getting on the carpet when I'm not home, animals have been living in the attic for 4+ months, dryer exhaust vents blow into the wall and not outside & im positive mold is grown under all the windows & in the bathroom walls.

This place lied to me about building a dog park so my dog & I would move in.

After moving in and the dog park not being built when they said it was going to.

I filed a BBB complaint & found out by a regional manager that a dog park was absolutely never going to be built and the staff who lied to me was fired & now I'm stuck in a lease they won't let me out of.
