Car sold with previous structural damage

I purchased a 2012 hyundai sonata on 10/2/2015 from Fairfax Kia. At the time of my purchase, i was advised that the vehicle was free of any structural damage and of an major defects. I requested a Carfax, which was promised to me, but never delivered. Within days of my purchase, I noticed leaking water around my sunroof, with the water draining heavily into both floor boards. Upon bringing it to the dealership, I was advised that they would remedy the problem, upon which they replaced my windshield which is what they stated was responsible for the water leak due to a crack. The vehicle was taken to M and M collision inwhich the dealership was made aware of the damage to the car. This, however, did not stop my leaking problem, which ultimately affected the electronics in the vehicle. When I returned to the service department, I was advised that the subsequent repair would cost in excess of $5,000.00, more than the vehicle is worth. Furthermore, upon notification from my insurance adjuster, I was notified that the vehicle had been involved in a rollover, prior to my purchase. I have reason to believe that the dealership was aware of this and I am frustrated that this was not disclosed to me. I am cognizant of the fact that used vehicles are purchased "as is", and I am also aware that this purchase falls outside the statue of limitations for Virginia's lemon law, but I sincerely feel I was wronged in this situation. At the very least, I believe that Fairfax Kia acted in bad faith when they sold this vehicle to me. At the very worst, I believe this to be a case of constructive fraud. I dont typically like to post these types of complaints in a public forum, but I dont want anyone else to go through what I had to go through. I am in the process of filling a compliant with the better business bureau and want to share my experience with others. They have lost a customer in me.

Fairfax Kia Car Repair Review

I apologize fro all of the typos. I am using Office 2016 and it has too many options.

Every time I pressed "I" it would write "o". Still steir service sucks and be prepared to fight to get basic warranty claims coverered.

Love the car though, especially since I just paid it off Weds. :)

This time I bought 4 OEM Nexen CP671 215/55/17 from the dealer on December 30th 2015. One of the tires had a slow leak. O inspected the sidewalls and tried to fond a nail once O narrowed down which tire it was. Of course the car has a TPMS system, but does not tell me which tire. I found it was the passenger side rear wheel. There are ver little forces on these tires. The just trail along where the fronts on a FWD car do 90% of the work. Anyway, there was no mark, no obvious puncture, it was leaking from the Inside. Or was a defect. With less than 1500miles on the tires the Service advisor (John Weaver-who just looks like her feels his job is a drag. Always. I always have to fight with FFX KIA to get a warranty claim covered. Mf. Weaver told me to take my car to National Tire and Battery or Merchants because "they deal with defects and warranties AMD we have no warranty relationship with Nexen. No relationship? They sell 10;000 Optima EX models just like mine ....all with Nexen CP671 as OEM. No relationship??? So I called Nexen Tire and got David on the line. He could not believe how I was treated. He said call him when I got there, and if they give me ANY trouble he would take care of it. They were not helpful. I called David, and he had the vice president of east coast sales have a chat with the GM. All of a sudden it was yes sir right away sir. I called John out about his telling me to go to another retailer who had NOTHING to do with this, his attitude, and general poor relationship with me. He knows I know about cars. Their $59.99 cabin filter replacement actually costs $7.99 at Advance, AMD takes 3mins to install behind the glove box. (see u tube). It is such a shame that they sell such a good product yet have dolts like Mr. Weaver working for them in service. AVOID DEALER SERVICE THERE. They have a good Google score....95% are sales Oh, in the first tome in 4years I was offered a car wash for the first time. So, buy there and service at Don Beyer Kia....3miles away..

This is the 2nd tie this has happened in 40k. My center console latch partially broke, meaning one of the two screws came undone and was rolling around inside the lid, and the remaining screw barely had the strength to keep it closed, so it popped open a lot. Now. I use the co sole a LOT. I am really OCD so I hate clutter... so everything is kept in the console or the glove box. So I open and close it very frequently to get my Vape system, and I rest my arm on it always.... even subconsciously, using it as a brace around tight off ramps, etc. So, my problem is not the center console lid breaking, but the dealer keeps putting the wrong one in to replace it. It is supposed to be leather on the EX, but last time they put this icky feeling soft-touch vinyl top in it. It took three trips..and on the third they took one out of an EX on the lot. So, now the same thing has happened. They claim the "part number matches". Well, if I was missing am arm and a leg came in.... the part number is just as meaningless. I have not had time deal with this.... but I asked the service advisor to please go and physically check it and make sire the material matched. He said yep..the part matches. That was a deceptive answer. He said it like the part NUMBER matches, but considering he was the one that dealt with it last time, then he knew what I meant and straight up omitted the whole truth. So, I am going over there to deal with it tomorrow.
