Installed a faulty damper in my fireplace.

Doylestown Chimney restored an old fireplace about 4 or 5 years ago. The damper he installed looked old but he assured me it was new. About 2 years later the handle of the damper fell off. He came and repaired it with a bent nail. It has just fallen off again and I have left 5 messages asking him to repair it correctly. He returned my call once and when he realized it was a repair to his work he has not returned any further calls. I think a damper should last longer than 5 years before falling apart. As it is I can not use the fireplace.
