This email serves as a formal report of neglect involving my father, Luman Swain, during his residency at Diversicare of Pell City, Alabama, from August 2025 through the first week of December 2025.
I am his only child and I reside in New York State, which required me to rely fully on the facilitys duty of care, professional judgment, and communication regarding my fathers condition.
During the above time period, my father experienced a severe and preventable decline in health while under Diversicares care. Most critically, he developed a deep wound on his lower body/buttocks, consistent with an advanced pressure ulcer.

This type of wound does not occur suddenly and reflects prolonged failures in repositioning, skin integrity monitoring, wound prevention, and timely intervention.
In addition to this wound, my father developed pneumonia, followed by sepsis, a life-threatening systemic infection. These conditions indicate that infections were either not identified promptly, not treated appropriately, or were allowed to progress without adequate escalation of care.
Of serious concern is the documented pattern that each time my father was admitted to Diversicare, he would subsequently be sent back to the hospital in worsened condition. This recurring cycle demonstrates a failure to stabilize, treat, and safely manage his medical needs within the facility. A nursing home is expected to reduce hospitalizations through competent carenot repeatedly precipitate them.
Throughout his residency:
- Preventative wound care measures were either not properly implemented or not documented
- Early signs of infection and respiratory decline were not adequately addressed
- Communication with me, as his only next of kin, was insufficient and delayed
- Escalation of care occurred only after his condition became critical
By the time action was taken, my father was seriously ill.

Sepsis does not develop without prolonged underlying infection, and the combination of a deep pressure wound, pneumonia, and sepsis reflects a pattern of systemic neglect, not an isolated oversight.
Demand for Investigation
I am formally requesting:
1. A full internal and external investigation into the care provided to Luman Swain during his residency in 2025
2. Complete copies of all medical records, including but not limited to: - Wound care notes and staging documentation - Turning and repositioning logs - Infection monitoring records - Nursing progress notes - Incident reports - Hospital transfer documentation
3.

A written explanation detailing how these conditions were allowed to develop under professional care
Statement Regarding Compensation
As a result of the neglect my father endured, he suffered unnecessary pain, repeated hospitalizations, severe infection, and life-threatening complications. These outcomes represent harm that was avoidable had proper standards of care been followed.
Accordingly, I am seeking appropriate compensation for:
- Medical harm and suffering caused by neglect
- Repeated and preventable hospitalizations
- Emotional distress and burden placed on our family
- Failure to provide the level of care promised and required by law
This matter is being formally documented .

My sister is a patient at this facility and was told to take a prescription that was for another patient. This was pointed out and the nurse said " oh oh".

The medication delivery device was stained and obviously used. The patient who was prescribed the medication could have died as the medication was ment to assist in breathing. I don't believe the facility hires people with the appropriate nursing training. The facility was over 90 degrees when we visited and the toilet ran constantly.

We were told work orders had been submitted for repairs; however, days passed and rooms flooded, leaving patients left fend for their lives in filthy, standing water. I am contacting the state regarding the horrible state of this facility and the danger they place patients's lives in due to ineptness and poor training of staff.

Additionally, treatments are given such as speech therapy for patients with hip replacements! My sister's doctor didn't order such therapy.
