Via home banking systems, we sent a SWIFT payment from Deutsche Bank to the Lloyds Group in November 2017, which, for reasons unknown to us, has never arrived. On three separate occasions, the originating bank has initiated a process with the SWIFT systems to return the payment, which, and perhaps not surprisingly, has not succeeded as the position in the receiving bank is that it has never received the funds, yet alone be in a position to return them. Subsequently, and this is the very disappointing and frustrating part, the originating bank has supplied us with documentation for the transaction including list of their outgoing transactions on the date of the payment request and transaction details from EBA Clearing, instructing us that we should investigate and follow up. Something that is extremely difficult to do, having now dedicated many hours to the task, as EBA clearing will not talk with private individuals for a single transaction, and the simply bank maintains that it has no sight of the transaction and therefore no information to go on. Four months later we are in a situation where both the originating and receiving bank are unable to locate the payment and with both essentially telling us to talk to the other. After a massive amount of communication and meetings with Deutsche Bank, it is clear that its approach approach is to wash its wash hands of the problem and that it accepts no responsibility to locate the funds or to solicit a solution with the other transacting parties involved. As such, this particular payment has disappeared to a black hole that neither bank is either capable or prepared to take on board to resolve. As a customer, seemingly there is nothing we can do.

I was working in Deutsche Bank legal Ops team... where my AVP Archana Karnan and shehzhan Khalid fired me from organisation.. telling I was not upto the expectations. We join organisation with lot of dreams. I had raised this complaint to complain team but instead of taking the employee concern they had contacted the AVP and VP and HR Akhila in Mumbai and closed the issue telling there was a problem from my end and not from their end. The HR usually considers the employee issue and solves but in this organisation the HR takes the personal support from the team AVP and VP and fire the employees.

My lawsuit against my mortgage company demanding they Produce The Original Note was just moved to Federal Court (cost $5.46 postage). The people who posted the foreclosure notice on my front door do NOT have the original note and therefore cannot foreclose and know it! Meantime they must continue to pay taxes and insurance. If they had the note all they had to do is tell me where it was located so I can view it. Everyone should challege the note that is on their door rather than running away with their tail between their legs. www.poshhhh.com Share this with everyone! www.poshhhh.com

125 East Eighth Ave

Eugene, OR 97401

Defendant.

CASE NO.:

Complaint for punitive damages for obstruction of lawful remedy

Amount: $499,999 plus legal fees

Obstruction of Lawful Remedy

Plaintiff GEORGE TRAN seeks damages as a result of Defendant John Beaver and Defendant Stan Surdam making legal determination on Plaintiff’s lawful remedy in response to Plaintiff’s current civil action Case No: 1210-0**** filed on March 5, 2010.

Pursuant of the Administrative Procedures Act (APA) of 1946 and the right of Habeas Corpus, Plaintiff have requested a verification of debt with Chase Home Loan Services following Federal Rules of Civil Procedures. See Exhibit A. Under USC Title 18, Part 1, Chapter 101 Section 2071, Chase Home Loan Services is required to maintain good safe keeping of legal documents.

Under Habeas Corpus, a Defendant is entitled to challenge his/her accuser. Chase Home Loan is making a claim that Plaintiff, Henry Onsan Young & Mary French owes them money. Plaintiff, Henry Onsan Young is entitled to request Chase Home Loan Services to produce proof of claim.

Under the rules of Generally Accepted Accounting Principles, a party may only be defined as a creditor, if they practice double entry book keeping whereby the Lender Debits his account, and Credits the Borrower’s account. Plaintiff, Henry Onsan Young and Mary French, wishes to ascertain that Chase Home loan financing is indeed a Creditor and therefore show Standing and a party of interest in the Controversy (Patton v. Diemer, 35 Ohio St. 3d 68; 518 N.E.2d 941; 1988). If Chase Home Loan can not testify through Affidavit or assay that they are indeed a Creditor, they have no Standing.

Chase Home Loan Services was given 2 opportunities to provide proof of claim on this matter. Plaintiff has sent notice to Chase Home Loan Services for a Motion to Compel (to be filed, awaiting green card confirmation) asking Chase Home Loan Services to produce proof of claim. Exhibit B

Under the APA, Chase Home Loan Services has defaulted on their opportunity to rebuke Plaintiff’s offer, thus showing prima facia evidence that they can not provide proof of claim. Therefore, have exhausted their administrative remedy. See Exhibit C.

Plaintiff therefore has notified Chase home Loan Services of their Default in this matter and filed notice with the Riverside County Recorder’s Office on May 14, 2010 (reference 2010-02****). See Exhibit D.

In addressing lawful remedy due to Plaintiff, George Tran, in full accordance to the APA and Federal Rules of Civil Procedures, have filed a revocation of Power of Attorney, and a Substitution of Trustee under a new Deed of Trust as a rider on May 14, 2010 (reference 2010-02****), rightfully naming Carol Anne as the New Trustee replacing the original Trustee (since Bank of America no longer have lawful claim on the controversy). Exhibit E.

At 1.59pm on Tuesday, May 18, 2010, Plaintiff attempted to file the Deed of Reconveyance (See Exhibit F) at the Lane County Recorder’s Office. Plaintiff’s right to lawful remedy was obstructed by Defendants John Beaver and Stan Surdam. Defendants did make legal determination and refused to record the Deed of Reconveyance. Defendants John Beaver and Stan Surdam quoted that only Bank of America may do the Full Reconveyance.

Defendants John Beaver and Stan Surdam also refused to file Plaintiff’s Deed of Trust assigning title to a third party. See Exhibit G.

To my knowledge, a recorder serves as a public servant for the purpose of upholding proper records but may not make determination of the nature of the paperwork put forth before them. By their refusal to record lawful documents that are in proper format, they are making legal determination on this matter and breaking the law.

In their interference, Plaintiff unable to sell his property to a buyer who was prepared to make a cash offer to Plaintiff. Plaintiff have thus lost this opportunity and have suffered true damage.

Therefore, Plaintiff seeks rightful remedy due to him and prays for justice.

For this purpose, Borrower irrevocably grants and conveys to Trustee, in trust, with power of sale, the following described property located in the LANE COUNTRY of OREGON.

See Exhibit A

which currently has the address of 2110 Escalante St, Eugene OR 97404

(“Property Address”):

TOGETHER WITH all the improvements now or hereafter erected on the property, and all easements, appurtenances, and fixtures now or hereafter a part of the property. All replacements and additions shall also be covered by this Security Instrument. All of the foregoing is referred to in this Security Instrument as the “Property.”

BORROWER COVENANTS that Borrower is lawfully seised of the estate hereby conveyed and has the right to grant and convey the Property and that the Property is unencumbered, except for encumbrances of record. Borrower warrants and will defend generally the title to the Property against all claims and demands, subject to any encumbrances of record.

THIS SECURITY INSTRUMENT combines uniform covenants for national use and non-uniform covenants with limited variations by jurisdiction to constitute a uniform security instrument covering real property.

UNIFORM COVENANTS. Borrower and Lender covenant and agree as follows:

1. Payment of Principal, Interest, Escrow Items, Prepayment Charges, and Late Charges. Borrower shall pay when due the principal of, and interest on, the debt evidenced by the Note and any prepayment charges and late charges due under the Note. Borrower shall also pay funds for Escrow Items pursuant to Section 3. Payments due under the Note and this Security Instrument shall be made in U.S. currency. However, if any check or other instrument received by Lender as payment under the Note or this Security Instrument is returned to Lender unpaid, Lender may require that any or all subsequent payments due under the Note and this Security Instrument be made in one or more of the following forms, as selected by Lender: (a) cash; (b) money order; (c) certified check, bank check, treasurer’s check or cashier’s check, provided any such check is drawn upon an institution whose deposits are insured by a federal agency, instrumentality, or entity; or (d) Electronic Funds Transfer.

Payments are deemed received by Lender when received at the location designated in the Note or at such other location as may be designated by Lender in accordance with the notice provisions. Lender may return any payment or partial payment if the payment or partial payments are insufficient to bring the Loan current. Lender may accept any payment or partial payment insufficient to bring the Loan current, without waiver of any rights hereunder or prejudice to its rights to refuse such payment or partial payments in the future, but Lender is not obligated to apply such payments at the time such payments are accepted. If each Periodic Payment is applied as of its scheduled due date, then Lender need not pay interest on unapplied funds. Lender may hold such unapplied funds until Borrower makes payment to bring the Loan current. If Borrower does not do so within a reasonable period of time, Lender shall either apply such funds or return them to Borrower. If not applied earlier, such funds will be applied to the outstanding principal balance under the Note immediately prior to foreclosure. No offset or claim which Borrower might have now or in the future against Lender shall relieve Borrower from making payments due under the Note and this Security Instrument or performing the covenants and agreements secured by this Security Instrument.

2. Application of Payments or Proceeds. Except as otherwise described in this Section 2, all payments accepted and applied by Lender shall be applied in the following order of priority: (a) interest due under the Note; (b) principal due under the Note; (c) amounts due under Section 3. Such payments shall be applied to each Periodic Payment in the order in which it became due. Any remaining amounts shall be applied first to late charges, second to any other amounts due under this Security Instrument, and then to reduce the principal balance of the Note.

If Lender receives a payment from Borrower for a delinquent Periodic Payment which includes a sufficient amount to pay any late charge due, the payment may be applied to the delinquent payment and the late charge. If more than one Periodic Payment is outstanding, Lender may apply any payment received from Borrower to the repayment of the Periodic Payments if, and to the extent that, each payment can be paid in full. To the extent that any excess exists after the payment is applied to the full payment of one or more Periodic Payments, such excess may be applied to any late charges due. Voluntary prepayments shall be applied first to any prepayment charges and then as described in the Note.

Any application of payments, insurance proceeds, or Miscellaneous Proceeds to principal due under the Note shall not extend or postpone the due date, or change the amount, of the Periodic Payments.

3. Funds for Escrow Items. Borrower shall pay to Lender on the day Periodic Payments are due under the Note, until the Note is paid in full, a sum (the “Funds”) to provide for payment of amounts due for: (a) taxes and assessments and other items which can attain priority over this Security Instrument as a lien or encumbrance on the Property; (b) leasehold payments or ground rents on the Property, if any; (c) premiums for any and all insurance required by Lender; and (d) Mortgage Insurance premiums, if any, or any sums payable by Borrower to Lender in lieu of the payment of Mortgage Insurance premiums in accordance with the provisions. These items are called “Escrow Items.” At origination or at any time during the term of the Loan, Lender may require that Community Association Dues, Fees, and Assessments, if any, be escrowed by Borrower, and such dues, fees and assessments shall be an Escrow Item. Borrower shall promptly furnish to Lender all notices of amounts to be paid under this Section. Borrower shall pay Lender the Funds for Escrow Items unless Lender waives Borrower’s obligation to pay the Funds for any or all Escrow Items. Lender may waive Borrower’s obligation to pay to Lender Funds for any or all Escrow Items at any time. Any such waiver may only be in writing. In the event of such waiver, Borrower shall pay directly, when and where payable, the amounts due for any Escrow Items for which payment of Funds has been waived by Lender and, if Lender requires, shall furnish to Lender receipts evidencing such payment within such time period as Lender may require. Borrower’s obligation to make such payments and to provide receipts shall for all purposes be deemed to be a covenant and agreement contained in this Security Instrument, as the phrase “covenant and agreement” is used. If Borrower is obligated to pay Escrow Items directly, pursuant to a waiver, and Borrower fails to pay the amount due for an Escrow Item, Lender may exercise its rights and pay such amount and Borrower shall then be obligated under to repay to Lender any such amount. Lender may revoke the waiver as to any or all Escrow Items at any time by a notice given and, upon such revocation, Borrower shall pay to Lender all Funds, and in such amounts, that are then required under this Section 3.

Lender may, at any time, collect and hold Funds in an amount (a) sufficient to permit Lender to apply the Funds at the time specified under RESPA, and (b) not to exceed the maximum amount a lender can require under RESPA. Lender shall estimate the amount of Funds due on the basis of current data and reasonable estimates of expenditures of future Escrow Items or otherwise in accordance with Applicable Law.

The Funds shall be held in an institution whose deposits are insured by a federal agency, instrumentality, or entity (including Lender, if Lender is an institution whose deposits are so insured) or in any Federal Home Loan Bank. Lender shall apply the Funds to pay the Escrow Items no later than the time specified under RESPA. Lender shall not charge Borrower for holding and applying the Funds, annually analyzing the escrow account, or verifying the Escrow Items, unless Lender pays Borrower interest on the Funds and Applicable Law permits Lender to make such a charge. Unless an agreement is made in writing or Applicable Law requires interest to be paid on the Funds, Lender shall not be required to pay Borrower any interest or earnings on the Funds. Borrower and Lender can agree in writing, however, that interest shall be paid on the Funds. Lender shall give to Borrower, without charge, an annual accounting of the Funds as required by RESPA.

If there is a surplus of Funds held in escrow, as defined under RESPA, Lender shall account to Borrower for the excess funds in accordance with RESPA. If there is a shortage of Funds held in escrow, as defined under RESPA, Lender shall notify Borrower as required by RESPA, and Borrower shall pay to Lender the amount necessary to make up the shortage in accordance with RESPA, but in no more than 12 monthly payments. If there is a deficiency of Funds held in escrow, as defined under RESPA, Lender shall notify Borrower as required by RESPA, and Borrower shall pay to Lender the amount necessary to make up the deficiency in accordance with RESPA, but in no more than 12 monthly payments.

Upon payment in full of all sums secured by this Security Instrument, Lender shall promptly refund to Borrower any Funds held by Lender.

For this purpose, Borrower irrevocably grants and conveys to Trustee, in trust, with power of sale, the following described property located in the LANE COUNTY of OREGON.

See Exhibit A

First, you would have had the reciept of the wired money, copies of the signed closing papers, then you will have reciepts and a log from the driver where the items were delivered and when. This should be pretty straight forward.

Either small claims (if your in the states) or a real estate attorney.

You will recoup your legal fees. Good luck!

We have been with Saxon for 2 years now after refinancing and it seem as though what ever mortgage company we get, we get screwed. First we had HomeQ and now we have Saxon.

We have no idea what our monthly payment is, cause it keeps changing and then all the late fees. Granted I wont lie we have been behind on our payments, the main reason is when we send in a payment we have no idea what to send in so we send in any where from 500 to 1000 a month and yet we get notices for being behind 3000. THere is NO WAY. Of course they wont talk to me cause I am not on the loan and my husband works during the day and by the time he gets home they are closed.

THey call all the time even on Sundays. I try to talk to them and figure out what the deal is and they wont talk to me. We have sent over faxed request (per their instructions) to allow them to talk to me and yet they wont.

We have sent the faxes every time my husband has gotten to talk to them. UGGGGG...I HATE THIS COMPANY!!!!!

Saxon mortgage and Duetche Bank have no clue

Someone on here recently wrote regarding Saxon and Duetche bank. I have had similar problems. My husband and I got laid off in 2005 (both at the same time) and we did a loan mod. Well my husband who is a college grad got laid off again due to the economy. He did get back to work and we do have the ability to make our monthly payments and all our other bills. Saxon refused to take payments, refused to to another loan mod (apparently it is their policy) ok but what about a payback yes but we would have to make double payments. Our regular payment is close to 4K per month. So I got a second job (working 7 days per week) and we now have enough to bring us current and they refused it. DAH what is wrong with you people. They said because it is the stage of foreclosure we are in.... WHAT in the blue blazes does that mean. We have a court date (we are in MA ) for next month ... So they would rather foreclose......I don';t get it...There is no guarantee that they can sell the house at a foreclosure sale. And certainly not for the value of the mortgage. I really don't understand how this morgage mess got so out of control. Banks are complaining they are loosing money. Well if I can 1500.00 instead of 1600.00 on a debt I would be delighted. Instead Banks choose to not take anything, then foreclose and sit on property (that they have to pay taxes on) for god knows how long. It makes no sense. And as for the investors they are getting ripped off by bad decisions.

Personal Loans advertised by banks

I have come to this Conclusion that all these banks who advertise Personal Loans are for people who already have money or have Credit cards with all the Limits available. Especially the Banks like Deutsche Bank. I had a little crunch in my business and required a personal loan of Rs3lakhs. I applied to Deutsche bank and submitted all my papers. I am self employed and have my own business for 5 Years. My IT return last year is Rs290000, My office has been same place for 5Years, and My Company is 5 Years old. I have been having a residence address for 18 years. I submitted my passport copy, my pan copy, and my bank statement for last for six months. I have credit cards from two banks and more than 2 years old and have a credit limit of 100000 on my Credit Cards. All the verifications were done. I called up the bank as I had submitted all the documents 3 weeks ago and never received a reply from Deutsche bank, The bank informs me that they have not approved my loan and do not give any information on what grounds have they refused me a loan. I asked the bank for a credit report or control number as I was informed by CIBIL that I have a right to ask for it but till now I have not received anything from the bank. I think all these banks should advertise that they provide personal loans to people on high interest rates only if the applicant has double the money in their accounts and all the limits available in their credit cards accounts and have properties then and only then they are eligible for personal loans. I feel this personal loan is just wasting of time as I have tried this for the first time I have realized it is simply useless and wait of time. I would say it is much simply to get loan from local financiers in the market then these claiming to high reputed banks. Is there any agency or has the government Of India given these foreign bank to Freedom to do whatever they want and they are not answerable to anybody?
