I sold a piece of equipment on ebay for $3600.00. I took this item to a local UPS store and paid them to package it for a UPS ground shipment. I paid them $50.00 for packaging, and then filled out the UPS ground receipt for shipping, using *my* ups account number for shipping.

3 days later, the buyer receives the package and its damaged. No problem? I had declared the package for the full value.

UPS comes out, inspects the package, and declines the claim. They say the package does not meet the UPS packing guidelines... the FOAM wasnt thick enough around the box. I say no problem, *YOU* (UPS Store) packed it. UPS replies that the UPS store is a different entity and that I need to file a claim with the UPS store.

I go to the UPS store, I say hey, UPS said that you packed my equipment, but you didnt pack it to UPS shipping requirements, so they denied my claim. They said, oh sorry, nothing we can do for you, you shipped it with your OWN account number and didnt pay the shipping through us.

According to them, they take no responsibility if the package they pack brakes...

I'm going to have top take them to court. It seems cut and dry that they failed to properly package an item for a company they they represent. UPS stores (since they share the name UPS) bare the trademark of UPS and to say that a UPS store is different from UPS and that a customer should understand that is misleading.

The buyer is now coming to me looking for a refund of their money, and I'm going to be out almost 4000 because of the neglegence of the UPS store in their packaging.

Appeal the claim. Regardless of how you paid, they packed the box, they are responsible.

Same thing with the UPS Store in Shelton, CT; they cashed the insurance check (I mean, "declared value" check) from UPS corporate, yet failed to return my item or disburse the funds, even though they were (are) in possession of BOTH the claim monies and my item.

UPS Corporate says: We already paid the claim to the "Shipper of Record" (which, in the UPS handbook IS the UPS Store Owner him/her self.)

Oh, and eBay Seller Protection is non-existent.

Had to hire an attorney and bring suit against UPS, eBay, the UPS Store itself, and the UPS Store owner personally.

Will take years.

I sold a jetski motor for 4K and shipped it with ups . My package was cut open with a razor blade the motor was taken out and they taped it back up and sent it on its way .

I paid for the insurance and still was denied . Ups sucks

Going through similar matter now with damaged computer packed by UPS store that arrived broken at destination with a ripped open box. UPS store claims reimbursement claim for shipping and cost to repair computer is being held up by UPS.

Has taken seven months thus far and no reimbursement from UPS. Now I am a FedEx customer.

Take them to small claims court. They let people pay them to pack and purposely don't tell you there's a *** rule you can't use an accoint to pay and also be covered.

Why that matters who knows.

They should mention it when people try to use an account. They are not clear about ups stores being totally separate - no one would assume this and they're using the ups name!

I sell high end smart tvs on ebay. I sold at least 20 tvs in the same box with the same packaging and box and went by the exact guidelines on the website.

My customer got the tv and the box was mangled crushed ripped and torn. The tv that was in mint consition was almost broke in two pieces. The screen was shattered, the casing was dented into scrap metaal. They tried denying my claim saying the packagin was not proper.

So I told them I want an appeal and also tge name of who ever I will serve court papers to if they try to pull that again. So I told them I could have packaged my tv in a tank with armor and it still would have been broken. The box looked like it was thrown down a hill and then ran over by a btrain. So I said how can u tell me.

The packaging was not right when your company demolisged the packaging before I filed the claim. So I sent pictures and also said if itt was not properly packes they sgoudnt accept the item. Also I said that the customer took the box apart anf took all the packaging materials out so how could they deny packaging when the customer took it apart and ups ruined it during shipping. So the claims department called me immediatly and asked for pics after they threw my tv into the box and all the accesories anfd wrapped tape around the box when I got it back in the mail I was appauled.

I never in my life seen something so smashed and ruined so I took pics sent them to the claims agency after I told them how I felt and as soon as she saw the pics and got the real truth they approved my claim within two hours. Just go after them and don't hold back make them feel like they can't deny you because how bad they look.

UPSStore Should not taKe High Value Pre-paid label. The Pack n ship guarantee only applied It you have the store pack It and ship for you using their acc #.

Since it IS Not their UPS account they Can't really do anything.That UPS rep. didnt give you a good explanation.

I'll dumb this down for all of you. Your account number, your problem.

The UPS Store's account number, their problem. Stop bugging the store owner, they can't help you even if they wanted to, which they don't.

The number to UPS is 800-742-****. Just another believer in entitlements.

Thanks intrafusion. The store of course refuses to do a thing and sent us to the 800 number, who says go to the store. This is absolutely insane!

I located a CS/media person for USP on consumerist, and a MBS corp email and will start there.

Is there any printed material detailing HOW this is supposed to work? WHO is responsible - the franchise or the regular UPS dept? I read through the pack/promise thing and it isn't clear, thought maybe I was missing some type of paperwork that described the process for these situations. Or, is there just none and they deny everything hoping we will all go away?

ultimately I called "the UPS store" corporate relations aka Mailboxes etc.. Filed an appeal with UPS constantly reminding them that the box was packed by their own franchisee and the UPS store them selves applied some pressure and UPS approved my claim on appeal (but still sited poor packaging as the cause).

I dont have their numbers handy anymore, but I'm sure you can google mailboxes etc corporate.

Intrafusion, I am in Miami too and dealing with the same exact situation. Our vendor that shipped mistakenly used his own account # and now the UPS store is deying based on that, and regular UPS denied as well.

Wondering if you could share who at corporate you contacted who helped? We are in contact with the actual store but as they're going by the account # issue for denial, would like to shoot of some letters to other departments.

If you use your own account # then the responsibility automatically falls on you. The UPS Store most likely packed it well, but during transit it goes down miles and miles of conveyor belts and that is where most damage occurs.

Had you decided to actually pay the store for the shipping instead of using your own account # then they would totally handle the claim for you.

I have managed a UPS Store for almost 10 years and have seen things damaged that were packed so well its unbelievable that anything could happen to them. Of course UPS will shift the blame on to a smaller company, it happens all the time.

Thanks for all your opinions. After hamming UPS store corporate, UPS and the UPS store, I receive a call this morning from UPS's crawford and company approving the claim.

Just for the record, I take the unboxed item to a UPS store. I say this is a $3600 dollar item that I want to arrive safely and to be insured. They say ok... no problem, we'll get it there safely. They give me a UPS ground shipment form to fill out and tell my name and UPS account info. I declare it for the value, pay for the packing and leave.

They knew what it was worth.

But anyway, regardless, I now have my claim open and UPS accepted responsibility.

In addition to all of the above, based on my declared value of $4000, clearly stated on my document, UPS failed to obtain a signature, which based on their "fine print" is required for any package over $999.00.

The nightmare is over! (I think).

If I ever ship something again thats damaged and they just leave it at the door, I'll just go and report it missing. It seems like it would be a lot easier!

What they will tell you is that if you drop an item off at a ups store then your insurance is only good up to $1000. I had the driver sign that form to no avail.

Nowhere does it say yiou have to take it to a UPS facility not a UPS store. Ridiculous. They have approved my claim not for the 3000 it was insured for but $1000.

AND they claim to have sent me two checks none of which have been rec'd. What recourse I don't have any idea.

Intrafusion your not paying attention. UPS did not turn down the claim it was the insurance company that insures UPS packages.

You don't even know who you're dealing with. Also the level of packaging differs with the declared value of the item.

Did you bother to tell the store how much the item cost and have them segregate the high value item from all the other packages which is required. You may have an account number but you know schitt about shipping.
