Contracted on a home.

From the start, right upfront explained that we were working through identity theft and once received and removed from credit a commitment letter would be coming from the bank.

We had a private home inspector check the property for anything that required prior to closing. We received the report the same evening all 46 pages of it with issues that needed to be repaired prior to closing which was immediately forwarded to Lennar.

We were assured all would be repaired prior to closing.

Some of the issues: dented refrigerator, cracked floor tiles, on both sides of the home we were told by our inspector that they needed to put in french drains, molding on the kitchen cabinets missing, electrical sockets taped to the outside of the house.

We were sold an extra large lanai, 10 feet. Lennar was not to sell an extra 10 feet on the patio homes. We ended up with 9 feet. Pavers shifting in the driveway and lanai.

Wrong counter tops in both bathrooms.

We were told we would have to close by March 29th. Bank said credit needs to run one more cycle and we were told NO. Lennar was going to rescind the Contract and would not wait one week for credit to be clear.

We reached out to the sales director of southwest Florida. She told us NO.

I told her I knew why they were doing this. IT WAS DUE TO HER NOT MAKING HER FIRST QUARTER NUMBERS.

Prior to us signing the Contract recision, Lennar sent out a blast e-mail to those looking to purchase a home that increased the purchase price by $10,000.00 indicating buyers' financing fell through which was far from the truth.

Here's a question...how do you offer a property that is under a Contract with a price increase??.

We immediately knew this was not a place we wanted to live us they told us that all the items did not have to be corrected prior to closing.

REALLY???

STAY FAR AWAY FROM THIS BUILDER. THEY HIRE SHODDY PEOPLE TO DO THEIR WORK AND IT TRULY SHOWS.

Not sure if we should sue them for breach of a Contract and the damages we had to incur in our rental apartment because we had given notice and had to go month-to-month for additional monies.

You didn't provide the reason why the Bank Declined? Trust me the builder wants you approved so they can get paid regardless of what quarter it's in. The Bank declined you for a reason.

Mortgage company needed to run our credit for 90 days due to the identity theft as our credit score increased due to items being removed from out credit. The 90 days would have been April 10th, 10 days after original closing date.

Having a law background in finance and real estate I know for a fact that they did not make their 1st quarter numbers and if they could pull it and resell for an increase of $10k it would work for Lennar. Please do not write a reply challenging me.
