I'm in the process of submitting a claim with Fred Loya Insurance. First off they are closed Saturday evenings and Sundays...what kind of shady company closes their claims office on weekends.

Sorry accidents don't happen Monday through Friday. Anyhow I left a message to get a call back Monday morning because I was inquiring about a rental car, seeing as we are now out a car. I never received a call back. I had to call this shady company on Monday to file my claim.

Talked to the adjuster that I was passed to and first of all she sounded like she was bothered by having to take a call then told me she would call me back. I had to stop her from hanging up because she never even asked for my name and number to call me back. A couple of hours after got off the phone with their adjuster, my daughter received a call (my daughter was the one involved in the accident) from the adjuster saying that they might not cover the claim because they can't tell if the drive of their insured vehicle was covered...hello you're an insurance company, know the laws of the states you are licensed in. In Colorado insurance follows the vehicle not the driver.

So as long as the driver is not an excluded driver they should be able to cover the claim. After my daughter called me to tell me that she got the call (even though I specifically told them to call me) I called the adjuster back. She answered the phone, didn't give her name, I had to ask if she was Jessica Garcia. After she said yes this is Jessica I said my name and she immediately she said she was on another line and asked me to call her back (that's terrible customer service...you never ask a customer to call you back).

I told her that she needed to call me back and she said ok and once again I had to stop her before she hung up so I can give her my information. About an hour later she called back and now all this frustration has built up before we can even talk about the claim. Jessica told me that Fred Loya Insurance doesn't even know if they will cover the claim because they can't get any information from their insured about the driver (the driver was not the insured...once again the insurance follows the vehicle not the driver. On top of that what kind of irresponsible person are you insuring when they refuse to give you information on the person they let drive their vehicle that later caused an accident...totaling my vehicle).

According to Jessica they can't tell if the driver was insured under the policy or even had a driver's license. Once again, sounds of a shady company, I gave them the name of the driver that the police officer wrote on the incident report. Jessica has access to all of their records to see if the driver was excluded from the policy. On top of that don't you think the police officer would have ticketed the driver for more than just running a stop sign if he didn't have a driver's license...come on Jessica use a little common sense when giving me excused to put me off....you could have easily just said you need to wait for the police report but you are trying to get in contact with your insured to get more information.

Now the original question I asked can't be answered because of the irresponsible insured and the shady insurance company that gave her insurance. I called my insurance company (Progressive) and they are more than willing to take on the claim and fight Fred Loya Insurance Company to recover my damages. Only set back to that is that I will have to pay my deductible out of pocket but in their fight to recover damages they will also recover my deductible. I guess you get what you pay for when you use Fred Loya Insurance...unfortunately I wasn't the one that used Fred Loya Insurance.

There was an irresponsible insured (who doesn't want to give her insurance company information on the driver she let take her vehicle) that decided to use them and lend her vehicle to an irresponsible driver that smashed into my daughter rendering her car useless while they changed their tire on their pimped out Escalade and went on their way. Now on to see how Fred Loya Insurance Company handles the claim.

I'm not impressed so far and would never use Fred Loya.
