Defective & Damaged New Restroom Trailer - No Manufacturer’s Certificate of Origin

Purchased a new ADA 2 Station Restroom Trailer for $32,800 from Comforts of Home Service, Inc. (COHSI), on February 20, 2014. Once the Restroom Trailer was placed in use in March 2014, we noted two leaks and immediately contacted Brad Martin, owner of COHSI. The Restroom Trailer has been non-operational since August 2014. We paid for 5 local companies to evaluate and repair the Restroom Trailer. Two companies stated that the Restroom Trailer waste tank is not repairable and required full replacement with new, because of historical failures in poly-weld repairs. COHSI has refused to authorize frame cutting and tank removal replacement at the last company. We have been in extensive written communication with Brad Martin, owner of COHSI. To date, the $32,800 trailer remains un-repaired and thus not in use. The Restroom Trailer waste tank cracked and continued to leak after being shipped back to Montgomery, IL in October, at which time COHSI reported “no leak, not a drop, no repairs necessary.” The restroom trailer continues to leak waste and leaked at the time of return delivery on 5 Dec 2014. The trailer has another mid-span leak of unknown nature that has not resolved. The trailer sustained additional tank damage when in COHSI shipping custody (not in customer possession). The ADA Restroom Trailer has leaked since “day one” and COHSI suggested various “fixes” by telephone in March of 2014 to no avail, well within the 90 day limited warranty period.

Moreover, though we paid for the Restroom Trailer in full, over one year ago, COSHI contrary to Illinois Statutes, has not provided Title or original Manufacturer’s Certificate of Origin, so we are unable to properly register the trailer in California, and obtain license plates for the trailer. We have demanded COHSI provide the required documentation over 10 times, with no avail. COHSI stated in e-mail the MCO was mailed in May 2014 but no proof or tracking information was provided to substantiate that claim. We have reputedly stated non-receipt and requested a replacement MCO however the request remains unresolved.
