Hurricane Micheal damaged our mobile home beyond repair and we purchased another mobile home from CCs Housing, Inc. in Lynn Haven, FL In January 2019.
Below describes the structural and safety issues we have had and continue to have with CCs and our new home.
We paid Cathy Cross in good faith and in full for site prep, structural wall and home construction and are now having to pay again for correcting structural mistakes, not pulling permits, damages and safety issues with the home.
1/19/19 signed contract and made down payment $26,671
Paid additional $4,200 for engineered prints as included in contract. Contract also stated stairs for access to home included.
Paid $8,000 extra for concrete wall
Paid balance due $123,985 in June 2019 Home sat in an open field for 6
months finally installed November 2019
Structural Wall Damage to Home, Safety Issues and County Code Violation due to no permit pulled
As a part of our contract and due to the slope of our property, a structural wall is required to prevent the home for falling down the slope. Cathy Cross and Heidi Hunt both told us we would need engineered prints for the wall, double concrete blocking and wall would include sides and all would be made of concrete block. Also told us they would pull all permits necessary for home and wall install.
All of this is included in the contract and we paid extra as outlined above.
We found out after the wall was built that NO permit was pulled. A neighbor called the building inspector anonymously and reported a structural wall was being built on our property and the inspector came to home site and told our neighbors no permit was pulled, who then notified us.
We immediately contacted the Washington Co building inspector and he confirmed a permit should have been pulled since it was a structural wall necessary to keep the home from collapsing. We asked him if Cathy Cross not pulling a permit was illegal and he stated yes. The inspector then tried numerous times in Nov 2019 to reach Cathy Cross.
She finally called him back she told him she did have engineered wall plans (supposedly two sets of engineered prints) for our home site and she would get them to him ...he has not received those to date. We have also asked several times verbally and in writing to Cathy Cross and no engineered prints have been provided to us to date.
The wall was supposed to be approximately 36 ft long with sides. It was built 42 ft long WITHOUT sides and is encroaching on our neighbors property.
When we called Cathy Cross and complained about no walls and the wall was too long and on our neighbors property, she said it was because we moved the location of the house several times?? This is NOT true nor relevant to the wall missing sides..We moved the location of the house on our property one time because she said the wall would be too high ...so we moved it once at her request.
And the foundation dirt will not stay without sides since its on a slope and the house will fall.
She then hired a young man to come out and put sides on the wall after the fact. He put wooden walls approximately 8 foot long on either side of the concrete wall which are too short, already gapping and bulging creating a runoff and caving in of the foundation dirt creating a safety issue for the home falling and damage to our neighbors property.
Dirt runs into neighbors patio every time it rains and water has continued to run down the hill to the seawall at the lake creating erosion and causing the seawall to cave-in. We now have to repair our neighbors seawall! Cathy told us sod will stop the erosion which is NOT a viable long term solution.
Dirt will continue to wash down the hill and the house will fall in.
We have tried numerous times in the past year to get this resolved with Cathy she either doesnt respond or doesnt show up to correct the situation.
In addition, the wall is encroaching on our neighbors property and was also built without proper setbacks per the Washington Co building inspector. We provided Cathy with a copy of our home site survey, so she could clearly see the boundaries of our property prior to any construction of the wall or the home installation.
We also had to hire a structural engineer company to retro approve the existing wall and draw engineered plans we ALREADY PAID Cathy for, another $2000!
The erosion and caving in created our home to be at risk of falling and we were forced to hire a concrete company to come in and put in emergency temporary sides on the wall in January 2020.
$1100
AND The interior and ext of the home are not complete either we cant receive a Certificate of occupancy until all done and stairs delivered.
AND had to hire them to cut 4 foot and 2 foot off the wall on either side due to the encroachment on neighbors property, (the erosion run off is running into the neighbors back porch and causing seawall to cave in) this will cost us another $10,000 plus! This doesnt include the cost of litigation that we are prepared to pursue if we are not reimbursed in full.
Preferred solution: Full refund
