They don't pull building permits.

stars-rating-full stars-rating-full stars-rating-full stars-rating-full stars-rating-full
AI Highlights
  • - Contractor failed to obtain a building permit and we fired them after nine months.
  • - They are suing for almost full payment for work never performed.

They failed to pull a building permit for our contracted work. When we found out, we told them to come back once they had the permit.

Nine months after the contract was signed, they still hadn't gotten the permit, so we fired them. They are now suing us for almost full payment for the contracted work that was never performed.

CAPITAL WINDOWS THE OLD BAIT AND SWITCH

AI Highlights
  • - Contract signed 8/28/2014; work for 10/06.
  • - Mail sent a new contract with different rates/terms and a 48h deadline; reviewer calls them scammers.

08/28/2014 SIGNED CONTRACT..RATES AND TERMS WERE ACCEPTABLE..WORK TO BEGIN ON OR ABOUT 10/06..THEY CONTACTED US 09/06 NEEDING SOME DOCUMENTS CONCERNING CREDIT REPORT...FAXED THEM PRONTO.....CALLED THEM 5 DAYS LATER AND SAID GOOD TO GO...CALLED 10/2 AND CONTRACTORS WOULD ARRIVE ON 10/8....THEY ARRIVED INSTALLED NEW WINDOWS.ALL WAS WELL UNTIL MAIL ON 15TH OUTLINING A COMPLETELY DIFFERENT CONTRACT..DIFFERENT RATES AND TERMS AND MUST HAVE IN THEIR OFFICE BY 48HRS. IT STATED THE WINDOWS WILL BE INSTALLED ON 10/22 AND WE HAVE TILL MIDNIGHT ON THE 18TH TO CANCEL BY HAND DELIVERY.

THE WINDOWS WERE ALREADY IN....THEY ARE SCAMMERS RUNNING A RACKET. THIS INFORMATION SHOULD HAVE BEEN GIVEN TO ME BY PHONE OR MAILED BEFORE ANY WORK WAS DONE.....THEY PURPOSELY HELD OFF TO THE WORK WAS DONE AND THEY HAD MY DOWN PAYMENT....I WAS TOLD GO FIND MY OWN LENDER OR ACCEPT THEIR NEW CONTRACT OR PAY IN FULL. AND THAT I HAD 48HRS. TO ACCOMPLISH THIS.

BE CAREFUL WITH YOUR DEALINGS WITH THESE PEOPLE. IN 60YRS I HAVE NEVER PURCHASED AN ITEM, SERVICE OR CONTRACTED WORKERS THAT REQUIRED FINANCING WITH OUT HAVING ALL MY OPTIONS LAID FOR ME BEFORE I TOOK PHYSICAL POSSESSION OR HAD THE SERVICE OR WORK COMPLETED.

i WOULD BE TOLD THIS BY PHONE OR MAIL AND OF COURSE HAVE THE OPT OUT OR CANCEL OPTION. NO ONE IN THEIR RIGHT MIND WOULD DUE THE WORK AND THEN PRESENT YOU WITH NEW CONTRACT A WEEK LATER

Did you fully read the original contract? I would wager that it had a clause that covered the financing issue clearly.

Most contracts will state something covering the fact that you will be responsible for payment in full if they are unable to secure financing on your behalf.

Should they have notified you of the financing issue before work began? Yes. Should you have made sure that the financing was set before work began (in writing)?

Yes. But ultimately the responsibility for payment is yours.

They can not come back and repossess the windows but they can put a lien on your property until they are paid off and send your account to a collection agency. And that will add more costs to your balance.

You could try writing a letter to the owner/manager/billing dept/etc.

and calmly outline the issue as you see it happened. Don't blame anyone, just state the facts as you see them and that there was obviously some misunderstanding of what was going on. Then propose a payment schedule to get the balance paid off similar to what the original contract would have had you pay. Be sure to put a line in the letter that says that cashing the enclosed check constitutes acceptance of the terms you have outlined.

Include your first payment check with the letter.

If they cash the check, you will have some leverage in court if they try to change things again or sell off you account to a collections agency.
