$15k deposit reversal

AI Highlights
  • - Contract signed Nov 8, 2022 with Calumet for garage repair; $18,125 deposit held for delay.
  • - In Jan 2023, $15,000 was reversed by Fifth Third Bank.

On November 8, 2022 I signed a contract with Calumet Buildings LLC in the amount of $35k to repair/rebuild the garage structure at 11115 South King Drive. A deposit $18,125.00 was tendered and deposited to my business account.

A 10 day hold was placed on the deposit. On the 18th of November the funds cleared. This hold took the performance in to inclement weather and it was explained to the client that the weather would delay the beginning of the performance, the delay was approved and acknowledged by Ronald Bates at that time. The architect, electrician, brick mason, welder as well as myself (General Contractor) were all brought on board for the project.

In the month of January 2023 there was a reversal of $15k by Fifth Third Bank back to Calumet Buildings LLC. After much prodding and probing I have never received an explanation explaining why a deposit of 50+ days would be reversed with the client being under contract. How could Fifth Third Bank make this reversal without an investigation or fact finding mission? Why was I not allowed to file a dispute regarding this action?

Why can't a complaint be filed at a higher level other than the bank that allowed this action?

How can Fifth Third Bank take such action against my business account and then refer me to the maker for an explanation as to why they forced a reversal of the deposit? Why is there no time line as to when a reversal can be made?

User's recommendation: Do stop fighting for what you believe, your financial rights, the secure and safe storage of your funds. This is not just for future customers, this also applies to my case. Seek a 100% re-reversal of the egregious act of taking your money. a
