WORST CUSTOMER SERVICE EXPERIENCE IN MY LIFE 72 YEARS
For almost 2 months I have been unable to get anyone at this company to resolve my loan status. Over twenty emails and over 20 phone calls.
Their official response by a loan officer was "you don't know how BIG this company is" the most arrogant caustic "loan officer" i have ever dealt with in 60 years of working with banks. After filling out two applications and following those up with phone calls I finally got a acknowledgement they received the first one but that was after over 30 days. I am still waiting to get the phone call interview they promised.
Bottom like it has been over 45 days and still no resolution. I'll be turning this over to my attorney who is my last resort.
Terrible
I called in on the 12th to have a payment drafted on the 15th. The representative assured me it would come out on the 15th.
However, it was drafted the same day and overdrew my account. They said it would take 3-5 business days to refund my money which defeats making the payment on time.
I am so sick of this company! I wish a real bank would purchase my loan because my payment has never been late but I'm stuck with these retards!!!!

Two years ago in 2015 received a loan mod. I was forced into making 3 months payment to stay in our home.Since then we made payments every month on time and our payments were put into a suspended account,our payments were never used for mortgage and sat there.Every month we were charged a late fee and corporate expenses,for what we still dont know and now they say we are 3 months in arrears,as our payments were never used for the mortgage.Now we have to go back for 13 months to prove we have made payments or m&t will foreclose.The worst scam i have ever encountered with mortgage fraud.I will badmouth this company for a truly ugly soul against hard working citizens.
Bayview Financial Home Loan Review from Bullard, Texas
My ex wife and I obtained a home loan through Swartz & Brough out of Austin Texas using my VA disability separation pay as the down payment. A couple of months later she kicked me out and took the house in the divorce proceedings.
I didn'teven know Bayview Loan Servicing LLC existed until I tried to obtain a home loan this year (15 years later) and found a charge off on my credit report. I understand that a divorce decree doesn't always release you from the debt ( as Bayview has very eagerly brought to my attention). However, my ex brought the divorced to their attention and tried to refinance the home. Bayview refused.
At the time that Bayview purchased this debt there was already a lawful order issued by a district judge stating that the property and the financial responsibility belonged to my ex wife that I have to obey. So not only did I not know that the loan was ddelinquent; I ddidn'teven know who it was being paid to. I asked Bayview to remove the negative item through the credit beuros.
They refused. I reported this to the BBB, that did nothing.
Fraud
I am filing a complaint against Bayview Loan Servicing a/k/a Bayview Asset Management LLC subsidiary companies of Bayview Financial Holdings for the reason being that the Foreclosure Manager in the Fort Washington Pa Branch Nicholas DeSumma I am under the information and belief is directing some of his staff to committ fraud. The Fraud that he is directing his staff to committ is when you run an SCRA Search on the Department of Defense Website to see if the Borrower is in the Military where you need a Social Security Number or a date of birth. The Date of Birth is not considered an accurate search. Anyway he states in an E-Mail to certain Employees that if you cannot locate a Social Security Number or a Date of Birth to use an Invalid Social Security Number of 999-99-**** and that is fraud and you will be using that Invalid Number on thousands of people who are not on the note but on the mortgage. Please See Below E-Mails The Employees did express there concern to this Manager that this is fraud and one actually completely refused to do it and I'm not sure of the others. When the one expressed his feeling and refused to do he stated that WE MUST DO IT which means commit the fraud. Please See Below E-Mails dated February 19, 2015, Bayview Sub-Services loans for Bank Of America where the E-Mails are involved about but to me personally I don't think that Bank of America is aware of this and that this was concocted up by this Foreclosure Manager of Bayview Loan Servicing from the Fort Washington Location. .

Hello All,
When encountering a situation where we have a non-borrower (Note) mortgagor, if we are unable to locate a SSN or birth date for that individual please run a DOD search using their name and SSN 999-99-****. Obviously not reliable but we have communicated this to Clayton several times and they still proceed to issue findings for lack of SCRA Certs in this scenario. As such, this is the course of action we are forced to take to produce a Cert. The alternative would be to adjourn the FCL sale and run skip traces, which BOA does not want us to do. I understand the frustration with this mess and feel the same. However, we have to ensure compliance from every angle.
Going forward, we must reference the mortgage and note document to identify all mortgagors & borrowers, respectively. Once identified, we must run DOD checks using their SSN or birth date when available. If neither is available, please run the check using the name and SSN of 999-99-****.

While I understand your position and don't disagree that the search is unreliable, respectfully, this is the process that must be followed. We have communicated this to both BOA and Clayton to no avail. They continue to issue findings when searches are not produced. Similar song and dance to running SCRA checks on deceased borrowers. Nonsensical. Nonetheless, we must do it.

Breach of private information
I have a home that is serviced by Bayview in another state. Bayview asked for my lease from where I am renting which I provided.
They then contact my landord and inform her that I am modifiying my home. This is personal information that I did not want my landlord or anyone else for that to know. This is a breach of my privacy. Not sure how this information will affect my relationship with my landord now that she knows I am having issues with my home.
I have been trying to modify my loan for over a year and Bayview is just now asking me to prove that I own the home. Incredible.
Be careful Bayview will keep asking you to fax the same information over and over again and you never move forward in the process.
Extremely stressful. I think they want homeover to just give up so their investors can buy the property dirt cheap.
House payments keep going up and was never suppose to.
We have had nothing but bad experiences with Bayview and feel like they are screwing us out of a lot of money. The reasons they are giving us for the payment increases doesn't sound right and one we confirmed to be a lie by our insurance co.Although we are wanting to refinance with someone else we feel like that we need to address these issues first.

Bayview Financial CALLING THREE DAY OLD CELL PHONE!!!!
This "Bayview Financial" called my cell phone...that I have only had for THREE DAYS! It is a PREPAID CELL PHONE and they called it on 3/18/12 and on 3/19/12. I answered it today and told them that if they called my cell again, I would report them to the Federal Trade Commission. I DID report them yesterday and considering they are a MORTGAGE BROKER and since I RENT...I have NOTHING to do with them! They are *** me off! I registered my cell number with the DoNotCall list, but that doesn't do ANY GOOD when we have to wait for 31 DAYS before filing a complaint! How is that supposed to help in this type of situation? Anyway, I returned their call yesterday and left a very NASTY message on THEIR answering machine, since they didn't leave one on mine.

Lost American Dream to Bayview Financial
Do not trust Bayview, they lie more than telling you the truth on your mortgage.
When I was first laid off last yeat, I called Bayveiw to explain what my job situation was and that I was concerned on making my payments. I ask for some help from them in anyway. They said that, get this,"That since I was not yet late that there was nothing that they could do." In other words, you need to run late on your payments, ruin your credit rating before help comes?
Well I did run late, because I just could not meet the payment. I could have with the Wisconsin unemployment benifits and some help from Bayview Financial. If Bayview would have helpped me by lowering my interest rate from the current 8.25% to maybe 5.75 - 6% then all would be fine. They insist on highway robbery at the 8.25%.
Since they have promised to help(I was told I qualified for Obamas Federal plan) but a drag out 6 months then I was told NO)and now it has been over year. Forclosure is on its way and they are unwilling to help me keep the house. Since then I have recovered my job and all is well financially except for the mortgage.
As much as I would like to stay at this location, I will not be robbed any longer and lied to. America will not be held by these terrorist. Not me, I will walk away from this mortgage at least with my head held high.They seem to want this property badly. Are they in the real estate business or the financial end to make money?
BAYVIEW CLASS-ACTION LAWSUIT
Hello All!
My Bayview horror story:
I am a victim of ID, bank and credit card theft, unemployed due to resulting Post Traumatic Stress; consequently, I contacted Taylor, Bean & Whitaker [TB&W], my originating lender, regarding loan modification although my loan payments were current and my homeowner's insurance paid through 08/2010.
TB&W went belly up. Bayview acquired my loan in 09/2009. Bayview notified me of the transfer in a letter stating that my loan was in arrears.
I contacted Bayview by telephone regarding their error and faxed copies of my loan payment receipts and my homeowner's insurance renewal certificate to show my loan was up-to-date to Brittany Sudderth.
When Sudderth corrected the errors to my account, I requested materials pertaining to loan modification and faxed her with my Hardship Letter and Financial Disclosure Statement.
Bayview responded by adding PMI and carry-over late fees previously waived by TB&W, thus increasing my payments from $346 to $371 per month.
My loan was assigned to Jason McDonald for modification in 01/2010. Three weeks passed without any communication from McDonald. When I finally contacted McDonald regarding my status, he informed me that:
[a] I did not qualify for loan modification
[b] my account was 4-months in arrears with a $1387 balance due
[c] my property had entered into foreclosure status as a result of the above.
I knew this to be incorrect. Receipts showing payments made to Bayview from 09/2009 through 02/2010 indicate the following:
09/23/2009 300.00 [for 09/2009]
09/25/2009 300.00 for 10/2009]
09/25/2009 71.30 [for 10/2009]
10/27/2009 371.30 [for 11/2009]
12/14/2009 300.00 [for 12/2009]
02/13/2010 300.00 [for 01/2010]
Summary
Account-in-Arrears: $1,387.04
Bayview PMI Overage: - 97.44
Bayview Carry-over Late Fees: - 193.14
Bayview Total Overage: $290.58
Total Payments to Bayview [09/2009-02/2010]: $1642.60
Bayview Balance Due: - $1096.46
Bayview-in-Error: $546.14
Clearly, Bayview is in error with or without the addition of PMI/late fees.
I immediately contacted McDonald to notify him of that customer service was faxed information showing Bayview's error, in receipt of my homeowner's ins. renewal certificate showing payment through 08/2010. customer service. I also informed McDonald that I placed the next payment due in the mail to show good-faith.
McDonald responded by informing me that payment would not be accepted because my loan had entered into foreclosure.
To date:
>>> I have not been served legal documents by Bayview indicating that my property has entered into foreclosure.
>>> Bayview has not acknowledged being in receipt of the fax showing Bayview's error or of the homeowner's ins. renewal certiificate.
Bayview:
>>> Illegally added PMI to my loan.

Please carefully consider the following:
Multiple consumers with legitimate complaints against the same company may join forces to file a class-action lawsuit to be taken on contingency by appropriate, participating legal counsel.

Describe the emotional duress resulting from Bayview's fraudulent business practices and how it affects you on a daily basis.
List healthcare providers and/or medications prescribed as a result of your interaction with Bayview.
When you are done, file your complaint with the government consumer protection agencies listed below by copying and pasting your complaint into the space provided in the on-line complaint form.

When Bayview took over the loan/mortgage, my x-husband and I were forced to take out flood insurance on property that hasn't seen enough water to get the ground wet nonetheless to flood the house.
We have a basement and I told them that I'd have a swimming pool before I got ANY water in the house. We have never had to have flood insurance with any other mortgage companies (we have had 3 others), they keep selling our mortgage and we keep getting the shaft with every NEW company.
I talked to FEMA,no help there, they say that we ARE in a flood zone. They haven't even assessed this area for high water since/atleast 1978. Since then the city has put in a draw area for the "extra" rain water to flow to.
I think it stinks that this company that sin't even in this state can dictate WHAT KIND of insurance I MUST have for my property.
Everyone calls my number and not Bayview Financial loan servicings number , which is 305-341-**** or

Is is Bayview Financial or Bayview Loan Servicing LLC?
Also: check your statements carefully for extra fees. For example: "corporate advance fees." These will most likely not be allowed as,based on what you stated, the alleged default was manufactured by them as they failed to properly credit your account.
See the mortgage and note as they should contain specific paragraphs about how your payments will be applied. If they failed to do this then they may have breached the mortgage contract.
Talk to an attorney who specializes in this area right away.
Many of the statute of limitations are short for actions against banks. I am not sure what state you are in but there is a National Organization: The National consumer law center that might be able to recommend an attorney who practices in this area that is located in your state.
