American Export Lines Lost of Cargo
This company lost my cargo to US Custom because they neglected to file import form before it left China.
The cargo was scheduled to arrive mid November and be ready for Christmas season sales. Now it's mid December, cargo is under control by US Custom and will be seized for public auction. This company refuse to take responsibility for their mistake because they don't want to pay the penalty to refile this form to US Custom. The penalty is $10,000. This isn't my mistake and they want me to pay. They are blaming everybody but themselves. They even go as far as blaming my supplier in China who is only responsible to transport the goods to their Shanghai port.
Date left Shanghai: 10/30
Date arrived in LA: 11/13
Date notify me that cargo will go into GO (government owned): 12/02
Date cargo went into GO: 12/04 (they notified me 2 days before it went into government control)

What they are talking about is the Importer Security Filing (ISF) which since has been in effect since January 26, 2009. This rule applies to import cargo arriving to the United States by ocean vessels and does not extend to air or inland shipments.
The information submitted in Importer Security Filings improves U.S. Customs and Border Protection’s (CBP) ability to identify high-risk shipments in order to prevent smuggling and ensure cargo safety and security.
Procedure: Before merchandise arriving by vessel can be imported into the United States, the Importer, or their agent (e.g., licensed customs broker or NVOCC Freight Forwarder with a signed power of attorney), must electronically submit certain advance cargo information to CBP in the form of an Importer Security Filing. Importers, or their agent, must provide the ISF Filing through the AMS system no later than 24 hours before the cargo is laden aboard a vessel destined to the United States.
It is important to remember that it is Importer through, their authorized agent, which has the burden of filing the ISF 24 hours of the loading of the vessel in port of departure.
If the Importer or their Agent fails to timely file the ISF, U.S. Customs will cause the goods to be taken to a special warehouse and under current policies, immediately impose the penalty fine, which must be paid before the goods will be released. If it is imposed but not paid with six months, the goods will be sold at government auction.
If the ISF is not timely filed, in order to assess who is at fault will depend upon facts not given in the above scenario, but certainly it is not the duty of the shipper to file the ISF. The ultimate liability will fall upon either the Importer or their NVOCC Freight Forwarder, whichever party is at fault for the non-filing.
In this case, it would appear that as the Importer’s agent, American Export Lines would be liable unless they can show that they requested, but the Importer did not provide, the required ISF information to allow the filing.
In this case, the Importer should have consulted competent legal counsel and if deemed advisable, brought appropriate legal action against American Export Lines for all damages incurred. Of course, if they sat on their rights, the Importer may very well have lost them to a statue of limitations on actions, which only a lawyer should determine.
