Taking legal action

Contracted company Jan 2015 to replace roof. Did not finance paid in full.

Everything seems fine at first. After less than a year roof seals were failing and had to be repaired. Another year later more seals failing. Instead of cutting and repairing TPO, they just put silicon over failing seals.

Poor workmanship resulted in several areas of roof pooling water. Result of pooling water trickling totally destroyed sunroom roof. May 2018 called for estimate of sunroom roof (12’x24’) and repair, again, of installed roof. Rudy came climbed half way up a ladder too pictures.

Never got up on roof to inspect damage. was then quoted for 530sqft. When I asked why I was being quoted for almost double the size of roof was told we can’t make money off of small roof so we increase the size to make profitable. Wanted to charge me almost $4000 for 12’x24.

Was not willing to pay that much, but still needed roof they installed repaired. For almost 3months straight called repeatedly to get someone to come fix roof. Even requested the company owner to call no response. Dave Mura Would not return calls, or answer texts.

After 2.5months he calls and says someone fixed it. Never called to setup visit just sent someone to my house when no one was home. And once again just threw silicon on pooling areas and said it was fixed. Yet roof still leaking water.

Now the water started leaking inside main house. When I finally got in touch with Dave Mura he said “I’m not gonna fix it if you aren’t going to pay” mind you roof was still under warranty. After he apologized for being rude he said someone would come to fix. another month went by with nothing.

And when crew finally showed up, gave no advance notice just showed up one day. Went up on roof to document work, when workers pulled up 3year old TPO, the pooling has turned the wood black. It was totally rotted. And Fernando the roofer actually said to me “this was done properly when it was installed, at the time we were still experimenting with TPO.

I was stunned that he admitted they didn’t know how to install properly. After repairing it properly and not just patching with silicon. Sunroom roof stopped leaking, and remember they said their roof did not cause sunroof damage, but now it not leaking. Safe to say their roof damaged sunroom roof.

Now 4mnths later and water once again coming down the walls in main house. Called Dave Mura, phone rang twice and sent to voicemail. So I’m pretty sure he declined the call, so I sent him video of of water running down wall, no response. Called company phone number explained what was happening and needed someone to call me back and come fix, no one returned my call.

Called 4 times on 12/20/18. And they will not call me back. At this point I will be retaining a lawyer.

And I have video and pictures of the poor work, as well as texts between myself and Dave Mura showing timeframe between requesting the work in May, and nothing being done until August. I was hoping Alan’s roofing would just do the right thing and replace the roof properly instead of having to take legal action but it doesn’t seem like that will happen

Shotty work and poor customer service

Roof was finally installed on March 9, 2016. No one from the company followed up with me for quality assurance or satisfaction and when I was finally contacted by the company, they were calling for remittance of final payment.

I let them know that a couple of the shingles weren't laying down and the contractor told me that it would take three weeks for them to lay down. I let him know that's great, because it's already been three weeks since the install. Contractor was supposed to show up by 6pm that evening to fix the issue and receive payment. I waited until 7pm for him to show up and then had some errands to run.

When I returned, I found the bill attached to the front door with comments on it saying "possible nail pop". I figured they were going to fix it and I didn't follow up with them. I was contacted on 4/13/16 asking for payment. I let him know that the issue had still not been resolved and he let me know that he would be there by 6pm that evening.

Contractor showed up at 6pm asking for the check. I let him know that he needed to resolve the issue with the shingle. He went up on the roof and tried to nail it down. He let me know that it's purely cosmetic and not structural.

I'm not used to shotty work being done for me and I expect things to be done correctly. He said that he would go back to the office and put in a workorder to get it fixed, but would require the check immediately. I was told by the sales guy that I would not have to pay until I was satisfied with the job and I kindly let him know that he can have the check once the issue was resolved. The contractor wasn't having it and said that the only way he would fix it is if I pay them first.

He then instructed me that if I didn’t pay immediately, he would put a lien against the property and that I would be responsible for all legal fees associated with it. I am fully willing to pay for the work and I’ve had the check ready in hand for almost a month now, but I need it fixed. Contractor kept saying it’s a warranty repair. To me a warranty means if something goes wrong after the work has been completed; however I don’t believe the job to be completed until both sides agree that the work has been finished.

I would not recommend Alan’s Roofing and I will not be using them for any of my other properties.

It’s sad that a company would risk bad publicity over something so simple to fix. They have left a bad taste in my mouth and I wish I would have gone with Total Home Roofing or Collis Roofing.

The problem with sites like this is that they never provide updates. This client's concerns were rectified within 24hrs and paid his final balance due on the roof. Resolved.

The workers had no tarp to cover the roof when rain came. One of the owners said he was going to walk off the job thinking I yelled at his workers.

Not very professional. All alans roofing is worried about is money. Said to me I should have had money a month ago. What a *** how dare he say that to someone living on a fixed income.

Alan's Roofing Inc does not service the Fort Lauderdale area. There are companies with similar names operating in that area. Please be careful to specify the correct company.

Anonymous; In the event of a derogatory statement that encompasses more than the business intended can & will be pursued in court. If loss of revenue is derived from false accusations, targeted at another business, not specifically stated, but directs towards other similar named businesses it is slander.

You will be liable for Compensatory damages which includes our Lawyer fees, court costs ect. as defined in the Florida courts. My legal staff & I are ready if you or your client has a problem with naming the correct business and not mine. As far as your threats of court payments or lawyers, lets let the judge & jury decide.

After speaking to my lawyers, we are willing to pursue this when you are ready. A copy of your derogatory letter will be supplied as exhibits.

Roof repair

I had Alan's roofing co. to repair our roof. The workers were so sloppy and ruined our solar

system, which I had to repair.

The roof itself is still leaking and the leakage ruined the plywood on the roof.

I certainly will advertise for your company in any way I can, because something like this,

is outrageous in business. The first time the roofers came, they even allowed a 10 year

young boy to be on the roof. Only one of the men spoke English, the others Spanish,

which I don't understand. The whole procedure did cost me $ 2460.20

That is incorrect Alan, you are accusing him of "libel" not slander, he has made an opinion and addressed it to your ficticious name which is the legal name you asked florida to be allowed to conduct business with other than your legal name and that IS the name you have registered with the florida department of corporations.

Anyways what he has done is expressed an opinion and an opinion is NOT a defamatory statement so you really couldn't expect to win a lawsuit (one word-it's not something that you wear and it's not a type of hotel/office room) That certainly doesn't preclude you from attempting to take civil action but remember that you would then quickly learn about another legal action called a sanction, specifically rule 11(b) and you would in all likelyhood be required to pay treble(three times) damages for any and all expenses paid by the defendant and his council, but hey if you want to be an *** remember that you buying your defandant's attourney a brand new corvette out of your own pocket is not entirely out of the question.

ALANS ROOFING, BROOKSVILLE FL-CONSUMER BEWARE!!!!

Alan's Roofing installed my roof in March 2011. When its windy, the roof makes a booming noise.

I received a call from an "Alex" of Alan's Roofing, who supposedly is in charge of "customer service". Alex then said he would charge me $95 if there was nothing wrong with my roof. I am a senior citizen on a very limited income, and cannot afford this charge.

It seems to be blackmail money to keep people from being able to hold Alan's Roofing accountable for any problems with their roofs, since no layman knows what is making the noise, and to be held hostage to a potential $95 fee probably keeps many people from having the inspection done, thus letting Alan's Roofing off the hook for for any shoddy work they've done. very nice little scam they have going for themselves.

If that is indeed true, then that is a dispicable business practice. They don't charge you a dime to come out and "Inspect" your roof then hit you with a 30 min sales pitch. There should be absolutely no trip charge for a post install inpection whether there is an issue or not.

What are they worried about, that every customer will just have them come out to inspect their new roof for fun and waste all their time? Perhaps there is something for them to worry about in genereal?

I was just considering calling them for my roof. I still will but will ask specifically about this policy and $95 potential trip charge. If it is true, then I will not use them.

It is a good business practice for follow up calls at no cost to existing customers provided it is a roofing issue.I have been out on numerous calls for roof leaks myself.These problems were either,window,sideing,drainage or foundation problems.I have waisted my time,gas and the opportunity to make a profit due to these calls.Believe me,there are a lot of calls like this.Some customers expect us to diagnose the problem for free and call it a roofing issue so they don't have to pay anyone else for advice.That is not fair for us, do you know anyone that will work for free??? Imagine trying to use that concept of not charging in the medical,dental,car mechanic,or any other service related field that was not related to there work. As it is we don't charge for estimates,try getting free estimates on

medical,dental,computer work,home appliances,car dealerships,ect.Make sure it's a roofing issue, therfor you will not be charged.If you are not sure,Call a home inspection company (they also will charge)if you are not happy with the roofing companies costs.

Do not use them they say they will fix things and call and never do. They did our roof we paid and then they came with over a thousand dollars more.

Contractor came out pulled all the nails out because they were not in studs was suppose to fix it and our gutters. Still waiting.DO NOT USE THEM THEY ARE LIARS AND CHEATS
