Social Security Administration - S.S withheld a survivor check from me for no reason.

Social Security withheld $927.00 from me September 2012 that I should have been payed, I called the 1-800 number and the lady I spoke to informed me that social security claimed I was over payed my survivor benefits for an entire year.Prior to this I filled out my student forms verifying I was still attending school.

The lady I spoke with verified the statements on file in NDRED. Additionally 11/27/2012 I received a letter that I was eligible for benefits to continue past age 19. I never received a notification of the over payment and didn't have a chance to appeal their decision?. I received my benefits due to me for October and November of 2012/.

When I made the first call the lady requested an explanation for the over payment and I received a letter stating they received the request for explanation and I would hear about the decision within 60 days|. I never heard anything so I called Social Security again at the 1800 number and the man I spoke with was very helpful and sent me a Request for Waiver of Over payment Recovery or Change in Repayment Rate form and told me to fill it out and take it in to Social Security and get a receipt for the turned in form|. I took it in today and the man that helped in the Social Security Office told me the waiver form was not necessary and filled out a Request for Reconsideration!.He also told me that they withheld the check before they even stated that I was being over payed/. So they had absolutely no reason to withhold it and I don't understand why it has taken so long just to get the ball rolling,.

So now its 1/16/2013 and there is no time limit Social Security has to come to a decision about their mistake'.They really need to change their bureaucratic ways cause quite frankly I am *** pissed. 2f932e0

If you have any other income and you fail to report it, eventually it catches up with you and you have an over payment.. I'm sure you received notification of this over payment and given your choice of how you wanted to handle it. I have an adult mentally handicapped daughter and every now and then she would be over paid. This even happened when she was drawing off her Dad's retirement Social Security, because he still continued working. At that time the yearly amounts that she was overpaid were quite large considering the small amount of benefits that she was getting. It never did us any good to appeal this, however I made arrangements for them to take a certain amount out of each check instead of taking one whole check.
