Here it is 2:40 am and I am worried about the foreclosure proceedings on my son and daughter-in-law and my 2 grand children losing their home. I discovered 2 days ago that my son is behind two months on his mortgage payments and on January 24, 2007, their home will be foreclosed on. Ever since America's ServicingCompany took over their loan in July 2006, it's been an uphill battle to get them to credit their payments on time. Even though they have a proof of delivery receipt, America's ServicingCompany will not credit their account and late fees are accuring. I have read on this website everyone's horrible dealings with this company and I'm pretty scared for my son and his family. My husband and I will help them to get back on their feet and bring them up-to-date but I fear this is going to cost us alot of money because of the company we are dealing with. Has anyone been successful in getting a straight answer from this company? Is there no recourse for families trying to make ends meet and having excessive fees on top of paying a mortgage? Can anybody help me to help my son and his family? I'm about to embark on a battle with ASC and hopefully find the proper authorities to address the situation. Losing your home is devastating to anyone!!!
Hey Amber you cannot get a copy of the checks cashed by ASC they do it all electronically. When I went after copies of my checks to show that I had indeed made my payments the bank informed me ASC does not send the checks back. What I did was get a bank official to send me a letter with the tracking numbers, dates and amount as proof that my payments were made and ASC had withdrawn the amount from my bank account.

ASC took over as my new mortgage company at the beginning of Jan. of this year and I recieved a statement a few days ago saying that I have a
escrow shortage of $1,333 and they want that paid in full and after that my new monthly payment will be $713 a mo. when my FIXED rate has been $660 a mo. since we bought the house in July of 2006. OR they give me any option of if I dont pay the escrow shortage then my new montly payment starting in June will be $824. Ok #1 I have never missed a house payment and #2 I have never been late on a payment either and #3 I have a FIXED rate so raising the monthly payment is more than likely illegal. I took this statement to the realator that helped me buy this house and next door is my house insurance company and I decided to go over there and see if my house insurance has increased, well while I was there I mentioned about the new company taking over and they looked at their records and ASC hasnt even contacted them to let them know they were the new mortgage company. So the 3 mo. I have been paying my insurance through the ASC they havent been paying my house insurance at all. I bet that extra money is going straight into their pocket! This company needs to be shut down and pay for everyone that they have scammed. Everybody intersted needs to get together and file a class action lawsuit, I am serious about this. I guess its crazy for a company to hold its customers accountable for the legally binding contracts that they signed. I have a mortgage with ASC and I couldn't be happier. No mortgage company in the United States changes your interest rate to *** over, the interest rate changes because you signed a doucment stating that the interest rates would change. It's not rocket science people.

Hello, I thought I was the only one having problems with this company. Everything that I have read has been done to me also. I am not sure what can be done about this company, but I wish something happens and soon. They are a horrible company, they are making their payments off of our mortgage payments. They don't work with people and if they do, they stick you in the end with a mortgage payment so high you can't even breath.

Yeah I hate this company!! I fed ex or ups or certify mail everytime I send a payment to these guys! Have date signature etc of when the recieve the payment and still they say its late and charge me out the butt for late fee's. I have gone the State attorney route didnt help, I have tried and tried to refinance this home with someone else, but they are effecting our otherwise decent credit with the so called bad pay. I am more than wiling to go in on a class action lawsuit with this stupid company, ohh do they call you the day after your bill is due? Yeah they do and they call everyday tillthey post your payment. If anyone is having the problems that it seems that everyone here has been talking about, Try contacting your state Attorney General's Office & ask for the Consumer Protection dept. & file a complaint.
My wife and I bought our first home and our loan was sold to these people. We never had late payments or bad marks until we had to deal with ASC. Our mess started when we got one payment behind due to an emergency and we live paycheck to paycheck. The next thing we know we are being charged ridiculous fees for this and that. I finally came up with most of the money to send them to bring us current and they tell me they won't accept the payment unless it's payed in full down to the penny(including more late fees.) I only get paid twice a month and my second check has to cover all the other monthly bills like utilities, food, etc. So now I have to wait a month which means more fees. We ask them for help to get us caught up because we keep receiving letters about how they care about their customers and are there to help you keep your home. Bullshit. They tell us our only option is a loan mod. To do this I have to pay one months regular payment which was normally $572.00(We have two separate loans), but it doesn't count as a payment cuz it is some bullshit application fee for this process. Two weeks later we get a letter stating that part of the restructuring process is some three month forebearance plan where we pay the regular monthly payment or less. At the end of the letter I was told for the next three months my payment was going up over a 100 dollars a month. Wait a minute, didn't it just say the regular payment or less? Not only that they gave me a due date different than our regular date and if it was to them and actually processed by that date we were disqualified. This is where it gets good. After paying the 592.00 fee my next available paycheck date to pay them was 2 days after our new due date. Imagine that. My wife calls and explains that we cant possibly get it to them on time with the new due date. They tell her well if it's just one or two days it should be ok. Wrong. We're disqualified. Fortunately for us they say there is still time to try the process again. Pay another processing fee and now our payment is $200.00 and month higher. My wife calls them to ask what the *** is going on they tell her its because all of a sudden our escrow account is negative $1400.00. An entire years worth of our insurance and taxes. I call them and ask how the *** that happened, they cant give me an answer. I call back to speak to someone else they tell me its because our interest rate went up, but I have a brand new statement in my hand and our rate is the same as it was the day we got the loan. I tell them to kiss my *** I want to talk to a supervisor, they cant find one available right now. I hang up, tell my wife we are going to take turns calling back and talking to different people. Over the next our between the two of us, we received six different stories from six differnent people. That was five months ago. So back to the modification. That is no longer an option because all of a sudden according to their computer we have applied for it seven times and it is no longer an option. Now I qualify for a repayment plan. This is the best part. All these months we went through this restructuring process I asked about sending in our regular payment. You know what they say. No. They will not be processed during this time. Our past due amount would be added to the end of our loan term and we would start fresh. Use the money to get other bills caught up. Well that nice of them isn't it? After five months of jumping through hoops for these *** sending in this paperwork, copies of paystubs, this and that all of a sudden I don't qualify. They say I don't make enough money. This is in mid november. They based their decision off one paycheck stub. The problem is I don't have a set income. I work at a large collision repair facility and at least half of my check or more is based off commission. After receiving their letter i gather all my paystubs for november. According to that I do make enough. I call them. Tell them I have proof that I make enough, cuz now they say there is no help they can give us and all the payments they said not to send in over the past months I now have 12 days to send them 3400.00 or they will foreclose. I tell them thats bullshit, I can fax the proof right to them. Nope, too late. The decision has already been made. By the way the woman says, you'd be wasting your time sending in paystubs because in the beginning of november someone new took over the company and did away with having to show proof of income. So why in the *** was I denied based off of one paycheck stub two weeks after they did away with having to show proof of income? I tell the lady to kiss my *** I'm calling the DSI and getting them involved and anyone else that I can. All of a sudden three days later I qualify for repayment plan. Now they tell me my monthly payment for the next seven months is over $1170.00. Can you handle that sir? Would that be a problem? I'm not violent but now I would give anything to reach through the phone line and choke the *** life out of this lady for even asking me that. Fortunately for me it was close enough to tax time that I was able to stall them for time to get my return and bring the account current. For some odd reason though my statement still reports our interest rate the same but my payment even though current now is still over $100.00 a month more because of higher interest rates. The best part of all of this is, the whole time they said not to send the payments in, they were reporting to the credit bureau that we weren't making payments so now no wants to refinance us because our credit went to *** thanks to them. ASC bought my mort out in 2006, and ever since them i have had the same problems as everyone else. they charge me late fees every time i make a payment, even if i send it out two weeks in advance with priority mail. they are now trying to forclose on my house because of the mound of late fees that i have accumulated because of this. i have even tried to switch mortgage companies and ASC has told them that i have thirty day late charges on my account so no other mortgage company will give me a loan now. the only reason they say that i have these thirty day late payments is because they sat on my payments and held them in suspense for two months before they applied them. ASC is a very crooked company that really does need to be shut down. i am sure that the better buisness bureau would have a hay day with this one.
I'm with ASC of Calif and in 07, I was sick and terminated from my job. My payments fell behind (and still behind). I called the mort company to see if they offer any help to me and my husband. The only thing they would offer was a modification, forbearance, or (as the rep stated), "sell your house". I was appalled, it was as though they (co) wanted me to be homeless!!!! I didn't choose this company, Option One chose them for me! I personally think it's the original mort holder to find you a suitable mort company if they are going to sell your mort, not leaving you "out to dry" so to speak! UNBELIEVABLE!!! I want out!!! Any suggestions out there?

ASC is HORRIBLE! I am not sure how and why they are still operating. They need to be investigated by the Better Business Bureau. They need to be shut down and all of thier loans should be sent to a much better company. Where did they come from! Hoepfully with some of the new mortgage laws they will no longer exist or homeowners will be cut a break!!!!
