Thyssenkrupp Elevator - Being bullied
Thyssenkrupp bought out our building's elevator maintenance company. The contract expired and I gave them 90 days notice that we were changing to another company as specified in our contract with the original elevator company.
(GESS) A very aggressive employee barged into my office threatening and demanding that I be interrupted to speak to him. When I called him, he was very threatening and said there was a narrowing window to cancel with an automatic 5 year non-negotiated renewal and I missed the window. (There is no such specific restriction in the contract. It only says 90 days notice.) I consulted an attorney and he said I complied with the contract and sent them a letter to that effect.
Now we have a letter from their attorney saying they are suing for the full amount of five years, over $8000.
They are so big, they already have attorneys working for them. We are a small condo association and hiring an attorney is a big deal.
Monetary Loss: $10000.

This is industry standard operating procedure from the large corporations....hidden "roll over" clauses in service contracts. TK won't even guarantee a monthly service vist....they specifically put intervals into the contract to allow them to weasel out of what should be a monthly responsibility. TK reputation isn't the best but, hey folks keep on buying those German cars to give them the excess $$ to buy out USA businesses and this will be the end result.
Go over the local office to a regional or national manager and see if they handle it differently.
Yes they are doing this to a Church I belong to. This company is unethicle, there.practices should be looked into by law enforcement agency.
